PlusNet threatening letters

Having been with Plusnet since 2004 I moved to TalkTalk in the first week of February (paying a third of the price and getting more than double the speed!). My contract with Plusnet ended in October 2012 but they are trying to charge me £111 for administration charges and 30 day notice. How can this be when I'm 4 months out of contract?

Did you obtain a MAC from Plusnet prior to the move and give it to TT?

I didn't need to get a MAC code as TalkTalk handled it all. It was very smooth. They said the switchover would happen on 7th Feb and around 1.30pm broadband went off, I enter the TT details into the router and was back online with a huge increase in speed.

I informed Plusnet on 15th January that I was changing and got a confirmation email from them, plus a call to try to get me to stay, so they can't say I didn't inform them. I also have an email from them stating that my contract ended on 15th October 2012 yet they insist on the phone that I'm still in contract. They now tell me they are going to dig out the audio of of the phone conversation when I signed up (it was an upgrade in October 2010 which put me onto a new contract).

If you told them on the 15th Jan that you were moving, and the transfer took place on the 7th Feb you haven't given them 30 days notice.

But I paid for the month from 15th January to 14th February so they have been paid for a month after I informed them.

Anyway, as I'm not in a contract with them I am not under any contractual obligation to provide notice am I?

You still need to provide 30 days notice outside of the minimum term.

Ah well, I guess if that's the case I owe them for 7 days, but £111 is a bit steep for that!

Depends on what the Ts&Cs says about admin charges.
  • Depends on what the Ts&Cs says about admin charges.

Their T&Cs say that an administration charge and 30 days notice is required if the service is terminated within the contract period, which I can fully understand, but doesn't have anything about outside of the contract period. When speaking to them on the phone they seemed to be convinced I was still in contract with them, despite me having an email telling me different.

Did you ask why they thought you're still within the minimum term?

Yes, both times I phoned them, and they said that as far as their records were concerned I was still in contract. They said they would review the recording of the conversation I had when the contract started and, in the meantime, I am sending them a copy of the email that states the end date of the contract.

It just all seems like sour grapes to me just because I wasn't prepared to put up with their lame excuses for poor speed and high charges. It was the tone of the letter that really annoyed me, saying it will be passed to a Debt Collection Agency within 14 days, even though this is the first I have heard about it.
