Thanks takeaway but I am a stubborn 'old' person and at this point compromise doesnt even enter my head as a way of a solution to this awful position they have put me in. I am to aggrieved and in the state of 'wanting heads to roll - one in particular' to be compromising!!! I am sure that feeling of rage will pass though. I am not going down the conciliatory road just yet!
I shall though do a wider search for an employment solicitor as they are a bit thin (non existant) on the ground round here.0 -
Right, I shall raise the grievance during the meeting and see what happens then. It is a very large organisation which likes to do things properly - even if underhandedly, threateningly and corruptly so I am sure they will keep to the letter of the law.....!!. The ACAS code states
"Where the grievance and disciplinary cases are related it
may be appropriate to deal with both issues concurrently."
So they can run both at the same time and reach conclusions at the same meeting. So once a grievance decision has been made, they can go straight on to the disciplinary decision. They do not have to wait for grievance appeals, for example.0 -
Oh, Ive just thought - when do I actually inform the investigator that I shall be going down the formal grievance road? Before, during or after this formal meeting on Monday?? I want him to know in no uncertain terms that I mean business and this line manager has just got to stop her bullying regime.
Unfortunately, he has no balls or a spine so it will all be covered up and over.
I'd state in the meeting that the thing you're being disciplined for is also what YOUR manager has been doing, so unless your manager is also going to be fired, you will be taking it to tribunal.

My point is is that if you compromise and get a small payment you can actually get an agreed reference so you don't have a massive gap on your cvDon't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -

If it's a disciplinary meeting, then unless your DD is a colleague or a 'qualified' TU official then she has no right to come with you, but the letter should state who you have the right to be accompanied by.Signature removed for peace of mind0 -
Oh thats a bit disappointing. Still, I think its an investigatory meeting. I have been advised to get a solicitor straight away. So I am trying to find one who specialises in employment law. The reference thing is a little worrying too.
On the letter I received to tell me of the meeting on Monday - I noticed all the dates and times were all muddled up. So, that fills me with confidence that they cant even get those facts right. I know that alot of what is going to be said will be untrue. I have got to be clear, concise, straightforward and 'professional' in my delivery.
My doctor gave me three sleeping pills to get me through the weekend.0 -
You say that you're being disciplined for doing what your manager and countless others do. I would be tempted to say that you thought it was normal practise to do 'it' that way, that you were only following lead from your manager and had assumed that it was the correct procedure for the situation.
But not knowing what 'it' is, that may not work, especially for something like helping yourself to the works equipment.0 -
Yes I told the investigator in my written statement what was going on and that my line manager and those above her had set a precedent. This will be discussed in the meeting - I hope anyway. I am so worried that he will just ignore the obvious and make me the fall guy for what alot of other people across the organisation are doing day in and day out. I dont want to come across as an angry and bitter employee. I want to underline to him that this person/persons are doing the same thing and that the punishment should be meted out to them as well as myself. I fear though, that wont happen. This man has too much to lose let alone the line manager who is/and will be protected at all costs.
Please be under no illusion that I am making this up and that is all sounds too fanciful. It is true and what is happening to me is disgraceful and shameful to say the least. The only people who recognise this as such are the people on the ground as it where. The powers and suits at the top have got their hands over their ears, over their eyes and a hand clamped to their mouth.
Bullying is rife where I work. But, the poor sod who gets bullied has no policy to fall back on, no meetings to discuss strategy, no support, no contact with anyone, total fear of others, no procedure (other than to follow it to the letter) - we are on the edge of our wits. We are treated very brutally in my view and in this day and age it is disgraceful that these massive organisations can still hide behind policy and continue to treat people in a cruel and dismissive way. Whilst smiling and nodding their head to one side and making small and insignificant promises - like ' we are suspending you for your own protection'.
Pah.
I also hope that the two people who have signed witness statements against me are feeling that lovely warm fuzzy feeling right now at their achievement. Also The investigator says he has ALL the witness statements he needs - so thats more than two but what less than 10 or 20? Its all so loaded against me and thats before I have even had the chance to defend myslef....0 -
I am going to do all my homework today. I am going to the meeting smart and confident - but not too confident. I shall be polite and courteous. I shall be forthcoming. I shall be above all - TRUTHFUL. If because of the dishonesty of one or two other people the meeting goes that way then I am stuck to say the least. But, I shall at least know that I have done and said my best.
I feel sick, shaky and so stressed. I fear that its a foregone conclusion however. Truth it seems is not enough to save one from the gallows.0
