    Interestingly the 7 year warranty offered by Kia is fully transferable to subsequent owners.

    IIRC it's even reset to the full 7 years if it's been registered to the dealer for under a year.

    I hope the op can get it sorted, as I would be livid about it.
  • Having recently visited a major vauxhall dealer lets call them carnold larks, with a friend he was categorically assured that the pre reg cars came with the lifetime warranty. He decided against buying the car anyway, he'll be glad now.

    Moral of the story: don't buy a Vauxhall! :)

    And with Toyota's 5 year warranty, its fully transferable


    Typical Vauxhall to have their warranty 'non-transferable'.

    reads to me like a standard 3 year warranty,thenthe 'lifetime' compnenet comes in
    So the new owner would have the remaining 3 year warranty

    According to Vauxhall's T&C for the warranty you should be able to argue that you're covered. The clause covering is this:
    1.1. Duration of the warranty, dependence on first owner

    Vauxhall undertakes that each new motor vehicle supplied thereon by Vauxhall as original equipment will be free from defect in material or workmanship according to the state of the art under normal use and service for an unlimited time period and a maximum of 100,000 miles. The warranty is valid for the first registered owner of the vehicle who bought the vehicle at a Vauxhall Authorised Retailer.

    The warranty starts with the date of delivery by the Vauxhall Retailer or date of first registration, whatever comes first.

    It's a general principle that, where a consumer contract is ambiguous, it should be read in favour of the consumer.


    In this case there are two points in that clause that suggest you're covered:


    (1) "the first registered owner who bought the car at an authorised dealer" doesn't include the dealer themselves (who didn't buy it at a dealer)


    (2) The warranty starts at delivery, or date of registration if earlier. Since it's limited by mileage, not time, that doesn't make any sense unless it's intended to cover cars which may have appreciable mileage put on them before delivery. Which would tend to apply to pre-registered rather than special order vehicles.


    Contact Vauxhall head office asking them (politely) to clarify whether their dealer has mis-sold the car (as you've described above) or has misunderstood the warranty terms.

    I read that. The only reason the warranty did not apply was that the car had been originally registered as a rental vehicle. This was not made clear to the customer though.
    It WAS sorted out in favour of the customer so there would appear to be a precedent there.

    I've now read the article again, it says the warranty is transferable if the car has done less than 200 miles and it isn't ex rental.
  • Next time OP make sure you get everything written down and signed by them if they promise these things.
