    Hiya

    In reply to your thread. The court will issue the claim (Check MCOL to see that it is shown as issued) and they write to the defendant. You will receive a letter from the court (will be with you possibly tomorrow) advising that the claim is issued and that the defendant has until such and such a date to respond. the total time that the defendant has to respond is in total 19 days from when the couirt issued your claim. The claim is deemed to be served 8 days after it was issued and then the bank has a further 14 days to either acknowledge, admit, defend or not repoly at all, before you then take the next step.
    I would imagine that if you issued your claim on Friday then it will have been issued today. FDo not do anything with the judgement button at present - it won't let you request a judgement this soon). you will need to wait until 19 days before you take any further steps. Just wait for your letter from the court to arrive in the post and it will tell when the defendant has until to reply.

    Sorry Ross slight crrection to my above reply. The claim is deemed served 5 days after issue by the court not 8 as I stated in my original reply.
  • Hi All, Hopefully somebody can help me. I started a claim with mcol which says issued 30/5/07. I am presuming that giving 5 days for it to be issued plus a further 14 days that i could request a judgement 19/6. My question is can i enter judgement by default at midnight(presuming they have not put an acknowledgement in) or can i only do this during office hours. Any advice would be greatly received. The claim is against Royal Bank Of Scotlend.

    Hi all this is my first post so please go easy on me :A
    I have gone through all the letter stages with nationwide and have now taken them to court via mcol.
    it was deemed served on the 10th june, they acknowledged on the 11th june.
    My question is what happens now , will i have to go to court, what do i have to put in my court bundle if needed as want to be ready to kick butt.:D
    This site is fantastic i have been watching from a distance for quiet a whille now but getting a bit uptight now and its for £4500 so alot of money please help me stay strong as its taking so long :confused:

    so do i just have to wait now to see what they do . what is the norm for nationwide as i know they like to drag it out for as long as possible. its just im going away the end of july do you think it would all be sorted by then :confused: as im not due back till the 20th Aug and extra spending money would be brill :rolleyes:

    They have 28 days from it being served to put in a defence, which to be honest will prob be the outcome, it would be tight & it depends whether they make an offer to you before & how much your local court has on its plate. Id sit tight mate but if you find it dragging on just make sure you let their solicitors & the courts know you will be away from date to date

    Thanks for that . will do but by reading lots of threads on here seems they make credits to your account befor 28 days are up but lets wait and see they just love to drag there heals my hubby and kids will be so pleased to get this back its been a struggle and nationwide couldnt give a dam so be glad to get one over on em . good luck to all go all the way :money:

    Further to my last post, I am please to say that Abbey did not responsed and as a result my judgment request has been accepted. I have now requested that they settle in full immediateley, however I am not sure how long i should wait before I issue a Warrant of Execution. Any advice or similar stories are most appciated.:cool:


    If you have requested judgment to be paid forthwith (immediately) you can request warrant of execution straight away. It entirely up to you if you want to give them time to pay x
