Hi savvykaz,
When did you receive your ccj claim form? It appears it happened very quickly on your case. I was told that this can take few weeks and attending hearing is unnecessary. What difference does it make whether or not u appear in the court? It's such an awkward moment. If I can avoid it, I think I would.0 -
Having been to court over a house repossession, I would just like to reassure those who are having problems with CCJ's that the experience is not as bad as you think it is going to be. I was nervous about attending but it was all very informal with just the judge and the agent and it gave me a chance to present my case.
Although you don't have to attend, I would recommend it as it is a chance to put your side of things and to show you are paying your debts and it does look more favourable. In my case the judge was impressed I had travelled a long way to attend and wasn't overly impressed that my ex partner hadn't bothered.
Just make sure that any hearing is at your local court (you can write and ask for this to be transferred if not).
Debt is nothing to be ashamed of, the courts are used to dealing with this in a sympathetic manner and do not always side with the creditors who are insistent on bully boy tactics, so you have nothing to lose.
Good luck with it and I hope it all works out ok for everyone.

I have been meaning to do this for ages. I was doing some spreadsheet updating and in two years of being on the DMP my OH's Halifax CC debt has only reduced by £414.72 even though we have paid £1,343.80. So got my act together, written a letter of complaint, got OH to sign it and sending it off today.
To be fair he has tried to get them to reduce interest and been told twice by customer services when he phoned them that interest would stop only to find it hasn't. Initially we thought it had because the statements only seem to show payments and interest every other month, probably something to do with the dates of when the payments go through. Enough is enough now and out of all our creditors the Halifax have been the only one to carry on charging us.DMP Mutual Support Thread No. 421

Apparently though, the reason they've started to recharge is because they've now refused our offer, even though it's the same as before.
Thanks, we're planning to send a 'please stop charging us interest' letter and we'll wait and see what happens. It's so frustrating though as they've been fine until now, nothing's changed but suddenly they don't want to accept the payment any more. I'm this far from saying right, you can have a token payment of £1 then and we'll put the rest of your payment to someone else!Our LBM: Dec 2011. DMP started: Jan 2012. Debt at LBM: £41,568

Although I can only echo the advice to keep on at them to get the interest stopped, it does amaze me how inconsistent BC are when dealing with debt.
Barclaycard have been the easiest one to deal with for me, moving the statement date until after SC pay them, stopping interest and changing the payment to a lower amount when another creditor was added in to my DMP and all without having to resort to a snotty letter.

It seems a strange line to take, to suddenly refuse your offer, after what, a year of payments.
Normally interest is charged again because your account balance has come back into the terms of the original credit agreement, and they consider it a 'live' account again. I guess this is where having the debt defaulted asap is useful.
As you have done, all you can do is re-state that you are on a payment plan, because you cannot afford the original credit arrangement.
Ask them to stop interest on this basis, as already said. It might just be a formality, and they will 'reset' the payment plan arrangement and stop / refund the interest.
Otherwise, I can't see their reasoning for the refusal. If they don't play ball, mention FOS.
It is their right at any time to decide the payments are not enough for them, but it would not in my opinion be favoured upon by FOS or a judge after first accepting for a year, so there seems little point in them trying it on.
But maybe that's their reason, they are trying it on to see if you can now give them more.
Anyhow, good luck. Will be interesting to hear what happens next.DO NOT PANIC.

Creditors can do irrational things like that.
When I was on my DMP, HBOS froze interest for two years then suddenly started charging for a year (on the grounds of they couldnt do any more to help me, like increasing my debt is helpful !), then after a further two years froze it again.
My other 2 CC crediors (Cahoot, Capital One) never charged a penny in interest.

This mornings post has arrived. Today I have received notification from Natwest advising me they have stopped all interest.
Also a letter from Cap 1 confirming they have accepted repayment plan and have issued a default notice already. Considering I haven't even made my 1st payment to SC yet, I presume this is good news?!?
