Thanks FTR. Do you know if they will ask for statements to support my budget. What will be the implication of not appearing in the court but sending the claim form on time.?

As FTR says, if you go to court you will be heard and the repayable amount set by the Judge *MAY* be less than what your paying now.

If you dont go to court Judgment will be granted anyway.

Ask to have the hearing moved to your local county court.

    Hi everyone,

It's great to read some positive steps on the thread, people becoming debt free after years on their dmp is certainly inspiring!

Daniellenick87 I am at the same stage as you I believe. Dmp set up from 1st August. Already had letters off capital one (sounds similar to yours) also acceptance from Mbna and the usual from sigma (Asda credit card) they are dropping rate to 1.117. Will talk to sc tomorrow.

Feeling optimistic but also very dubious as we have 17 creditors (ouch) but decided as often said in here, they can't have what we don't have! Regardless of the worry moments they are not half as much worrying as I was wondering if we had enough money to doa food shop and the dreaded texts each day if my overdraft balance! Fir the first time in my life we are 10 days off pay day and we have a credit balance. Not a great deal but enough budget for food next week and diesel! Certainly don't regret the steps we've taken, anyone deciding whether its for them, my advise if it makes sense do it! Just for the piece if mind :)

Hi everyone. Hope you're all enjoying the sunshine. I've recently gone self-managed (using NEDCAB) after being with SC. Moorgate who have taken over debt from MBNA now want me to complete their own I and E form so they can set up payment plan. Is this a standard request? They also wanted to know why I'd left SC and said they would recommend staying with them.

Have you already sent them NED CAB I&E? They shouldn't need their own as well as this but there is no harm in filling it in as long as information provided is identical to CAB and does not disclose any further information but I think I would be tempted to send their form back empty with the NED CAB one attached.

It's really none of their business why you left StepChange and they are not entitled to treat you any differently with regard to your debt. If you need to say anything, just say you decided to swap one free charity's help for another.

Good luck and please let us know how you get on :)

It does sound like you are writing about me. I was living payday to payday. By the middle of the month I was struggling financially and turned to credit to see me through.

Originally I felt very nervous about going down the DMP route. But after receiving confirmation about 5 debts that they are freezing interest, it is looking ok. Only got to hear back from another 2 creditors.

The way to think about is thats its cheaper for your creditors for you to keep making regular fixed payments than to keep writing to you or ringing you.
Also if you make a complaint to the FOS that costs them £500 (I think).

So if you keep paying & increase your payments when you can, you wont have any problems !

    Good luck !

Thanks for this. I haven't sent them NED CAB I + E but will do so and attach their empty one. Brilliant advice as usual:)

needed a new washing machine as I thought the one that I have had for 6 years stopped working, thought the call out and spare parts would be more than a new machine, being on a DMP would have had to save up for one-but now being frugal minded wasn't keen on spending a lot of money--got an engineer's number from brother in law- brilliant news ---all it needed was a new heater and the total cost was £40.00p and that came out of the emergency fund(one happy bunny! )

Aqua are being awkward yet again. I got my statement this morning showing rhat they had added £38.50 in interest, it was previously around £16-17. StepChange had paid them the usual £31.44. So my debt to them is actually now increasing.
I called them and managed to remain calm but they were no help. The advisor couldn't even explain why the interest had increased. I asked to speak to a manager but apparently none were available. I have written to them 3 times over the past two months aking them to freeze interest but have had no response. SC have also written to them 3 times.
I am going to send a final letter to them via recorded mail if nothing comes back i will be making a complaint to the FOC. In fact, i might just do that anyway.

Yes, I think you should do that definitely.
If my creditors start adding interest, I will send one letter of request, then one with a mention of FOS.
If I had no reply then I might ring before going to FOS.
That said, these firms are notoriously slow, especially the big banks. So I would give them a few weeks each go.
As long as they stop and refund the interest I don't care how long it would take, and of course I wouldn't stop.
    DO NOT PANIC.
The future is looking good now...

Hi everyone, I recently set up a DMP with SC. Made first payment in June but was made redundant at the end of May so made a token payment this month. My creditors are:

Post Office - heard from SC that they rejected my initial proposed payment. SC said to ignore any letters from them but only report if they pass debt on.
Barclaycard - They have accepted payment plan.
Nationwide Overdraft & CC - They have accepted payment plan.
Santander - Haven't heard from them just default notice
Sainsbury's Finance (Loan) - Haven't heard from them just default notice - Worried about this one as got a letter today wanting over £900 by end of July.

I haven't received any redundancy yet (only in job since Oct) as co. is supposed to be liquidating so that will be a long drawn out process. Desperately looking for a job as I am keen to restart payments. Just wish I could sort it all out!!!
