Please help - Sold car and its now got a fault, buyer wants refund/bring car back

    After selling a certain amount of vehicles in a year

    Your classed as a trader

    your story sounds like a garage trying to sell off older cars under the radar as they say apologies if that sounds harsh ,but that's how many would see it

    The guy has had it for 2 weeks, he could of been thrashing it. You cant expect a 2 week test drive surely?

    How many years have your friends owned the vehicle and whose name was on the V5C?

    Picking it up from a garage forecourt would also have me wondering if they had offloaded some dodgy trade on me as a private sale.

    How many cars have you listed on your account? What other items do you sell?

    Yes hes on the V5 and about 6 years off top of my head.

    He has road side parking only and would have had to reinsure it just to have it sat there, putting it at in laws garage meant it didnt need to be insured as far as im aware.

    This is the third car ive sold. other stuff ive sold include a couple sets of wheels off scrap cars, and my own personal stuff like cycling gear. Ive bought some stuff for the garage, eg engines off supplies off ebay etc as well again stuff for myself like cycling clothing. Its a low use account
  • The long distance rights of 28 days is a new one on me. Distance selling regs don't apply if you collect the goods in person.

    I'd say the sale of goods act may apply and in that case within six months you have to prove the fault wasn't present when the garage sold it.

    I hear what your saying, but the vehicle is not the garages. it is not on the logbook.

    To be honest we just got in touch with the owner before he goes on hol tomorrow and he said, if it has to come back and give the guy a refund them we can.

    My issue is that he will now have a broken car that wasnt broken when he sold it, the other chap has had it for 2 weeks and used it, It could have happened 6 months down the line and he would have no come back?

    3rd car in what timeframe though?

    Selling cars and buying and selling car spares. Would add to their case that you are a trader.

    Was it listed as selling for a friend and contact them or did you deal with it?

    As mentioned we picked him up from the station in it and his response while in it was 'hey this is alright, nice motor'.

    So no it wasnt present when we sold it.
