    If it is a binding contract, it would apply to both parties. So no reason why consequential damage should not be claimable by either party. Cannot see it flying though.

    In this case it does not appear that the OP informed to taxi co of the possible liability at the time of booking.

    Actually yes you should. If you book a taxi and after they turn up change your mind you should pay their standard fare from their central to the zone the collection point is in... Or if for example you book a taxi from a different city back then you should still be liable for the fare if the journey has been undertaken, even without you.

    If you hold the driver up they charge waiting time. This is part of their fare structure.
  • ok, so i've read some of your responses some are helpful and some aren't so helpful, but thank you all anyway.
    I'll reply to some questions or topics which seem to need clearing up.
    A) The taxi was not late, it did not arrive.
    B) I contacted and spoke to the company at 0745, at this stage I was informed the taxi had not shown up as the taxi driver booked for my run, did not show up for work.
    C) I gave the company the option of picking my partner up and making the journey to the airport. The driver I spoke with did not have the authority to say yes or no to this. I was told he would contact the owner and call me straight back. 15mins later I had still not heard back, I called again, was told the same thing and that I would get a call back within 20mins, this again did not happen.
    D) Witnesses mentioned are all housemates, and therefore could not be considered impartial. However since then I have three more impartial witnesses in the form of security officers for where I live.
    E) The taxi company have verified numerous times the correct address which I provided.
    F) I now also have confirmation and evidence that the taxi did not arrive since the entrances are all covered by cctv, no taxi entered between 0700 and 0730. When asked for the make, model and registration of the taxi, the company ceased answering my calls made to the office and owner?

    Speaking over the phone is not always clear and it can be easily misheard. If the OP didn't ensure they had the correct address details then that is their own fault.

    Also the OP should have contacted the contract provider before paying additional expenses to get their partner to their destination. The taxi company was offered no opportunity to drive the partner to the airport.

    Anyway as I've said this wont go to court.

    As I've just stated the company was given the option to drive to the airport.
    Initial five witnesses were not impartial, three further apartment security staff are impartial, as is cctv.
    Correct address has been repeated back on numerous occasions as well as during the conversation when booking was made.

    I agree, or maybe we should be liable for fare that was lost (one assumes they may get another fare when they realise the person isn't turning up). But I think people would be indignant if they were told to pay for it!
