Hit by 3rd party on roundabout - claiming not at fault, have pictures etc..

Hi!, first of all this is a long (ish) post will try and shorten it as much as possible. But ultimately 3rd part hit me on roundabout - not accepting liability, evidence I have is detailed below.

Situation:

At roundabout I was in right-hand lane indicating right (road markings right only). 3rd Party (van) in left-hand lane (road markings left & straight ahead). The cut roundabout going straight ahead, hit passenger side of my car (no passenger). Car not pretty sight but able to drive ok.

I took pictures on phone of van, since driver didn't know insurance details van had company details on, also got the drivers name, reg plate etc... but due to shock didn't take picture of damage to van. But did take picture of my car.

Bit more info regarding pictures:

had GPS on phone so location of images is stored, can see part of van parked on curb with traffic island visible, separate picture of damage to my car.

Partner came to scene took picture of Tyre tracks in mud on roundabout (might be able to make out Tyre tracks, not 100% sure) i thought initially they where skid marks but you can see it is mud, hopefully if i can match with my tread can prove position of my car.

Basically I have pictures of damage to my car with white paint on my car (van was white, my car is black) and images that I can prove he was in the area and very close to roundabout (on curb parked on double yellow lines as was I - naughty I know) when picture of van was taken and separate picture placing my car behind his (just after roundabout) less than 2 minutes later. I've been back to the scene and took a panoramic shot to show location of traffic island to prove where he had parked.

Erm... think that's it. Hope it makes sense?

I can upload pictures, screenshot of phone with location of photo's etc if it will help you guys? Just let me know.

    Get a picture of the road signs and directional arrows on road also.

    First of all the 3rd party insurance will almost ALWAYS dispute liability in the first instance. He probably hasn't even filled in his accident report......

    Unfortunately without video footage, you have no way to prove anything :(

    OP, are you saying he crossed into your lane and hit you or are you saying he didn't go straight as expected and you collided with him as you exited the roundabout?

    Hi! no I was turning right in the right hand lane (arrows are right only). He was going straight on in left hand lane and rather than follow the curve of the roundabout went straight e.g from left lane cut into the right lane (where I was) and went into my passenger side. This happened less than 10 minutes before I was due in work, to get to my place of work the only way is to turn right at this roundabout then after about 100 yards turn left into works car park. If it goes to court I can prove that this would be an appropriate time e.g add weight that I would normally be turning right at that time. If that makes sense. In case they try to say I was going straight on.

    The bold part has really confused me. If he was going straight on and continued to go straight that would be the correct thing to do. I'm obviously not reading this the way it was intended.:huh:
  • Sorry to hear your troubles - My partner was hit side on by another driver and she took the full blame with no funny business whatsoever. Her insurance was on the phone next day to sort it all out. We were lucky and I know this is rare as these days people just deny fault regardless and let the insurance companies fight it out. All very stressful for the non-fault driver. Not sure how but something needs to be done to stop this. Good luck!
