Hit by 3rd party on roundabout - claiming not at fault, have pictures etc..

  • The bold part has really confused me. If he was going straight on and continued to go straight that would be the correct thing to do. I'm obviously not reading this the way it was intended.

Instead of following the curve of the roundabout ie sticking to the outside, he cut across the outside and inside lane.

If you join a roundabout and when going straight over literally drive straight across rather than follow the curve of the outside, you need to hang up your keys.

It was a laned entrance to rdbt, was it laned on the rdbt?

You should have stopped your car immediately and taken pictures of the car position at point of impact. Without this and without witnesses you are going to struggle.

You're missing my point - witnesses disappear very quickly, if you don't get their details very quickly they'll just drive off. You can still leave your car stationary at the point of impact and get photos later. Photos are still important but you need to prioritise getting witnesses.

The photos were of use in your case because neither you nor the bus driver had "independent" witnesses. Had there been car drivers behind you or the bus, who catagorically stated that the bus driver was at fault by cutting the corner, it would have been far more clear cut and probably never have got to court, don't you agree?

No I don't I'm afraid. The driver flat out lied, claimed he'd been stopped at the time because he was checking the way was clear. the pictures showed that to be a lie and showed the back of his bus still over the white line.

The likelyhood of people stopping these days is minimal, my friend was knocked off his bike by a white van who just drove off. The car behind waited patiently for a gap in traffic and drove around him!

You specifically said that pictures weren't that important, I don't think that is good advice. The OP might not do weel because they admit they missed out lots of key points but in my experience getting decent pictures and plenty of them is no worse than having access to CCTV. Witnesses might not have seen everything and can be quizzed on their memory, pictures cannot.
What if there was no such thing as a rhetorical question?

Photos taken 5 minutes later would have still shown exactly the same thing.

Exactly my point - that's why it's important to get a witness quickly.

As I said you're still completely missing my point - Get witnesses, then take photos.
