Argh so much FUD on this thread. Seriously, does anyone have any actual concrete evidence of any of this? Or is it just guesswork? I've never heard so many completely contrasting opinions on a single topic..0

Also, FYI - just checked my credit card statement, looks like they have processed the chargeback already. There is a new transaction showing up, for a credit for the original amount debited, with transaction date of 4-Dec (the original purchase date) and a posting date of 5-Feb (yesterday). The description is "DISPUTE AMOUNT". So I guess this is a chargeback? Or could it be a s75 dispute?
I just logged on to my Paypal account, and so far everything seems fine - nothing about it being blocked or anything. But the refunded transaction also doesn't show up, so I'm not sure if that's because it won't ever show up, or because they haven't updated their records..0 -
I know from my own experience that use of Paypal denies protection under Section 75. I understand however that if Paypal has a Commercial Entity Agreement with the vendor Section 75 may still apply although your cc provider will be unaware of this agreement and so will shirk any claim by default.
Paypal therefore need to make the existence of any such agreement clear at the time of purchase. It is currently a potentially serious issue and because of it I would argue that the advertising claims that Paypal is more secure are currently misleading.
Paypal buyer protection is usually quite good but can be a major pain given rigorous time frames, multiple stages and delays.
I have found the following approach useful.
Try to use your cc directly if possible.
If goods paid via Paypal don't arrive within 30 days of payment then file and escalate a non delivery claim immediately. This has always worked.
If there is a problem with goods that have been received this can be more problematic. If the seller is a rogue or is uncooperative, the buyer protection window has lapsed or a buyer protection claim is unsuccessful then post the goods back to Paypal in Ireland and get proof of delivery. Continue to contact Paypal via recorded mail. If Paypal don't refund (they have on the two occasions I have needed to take this action both with rogue foreign sellers) I would contact my credit card provider and explain that the goods have been returned to them.
I have to say that out of hundreds and hundreds of Paypal transactions I have had to make maybe ten claims and of these only two were a problem. None the less the FSA need to get up to speed and date and make the cc companies and Paypal ensure Section 75 protection is maintained. Credit is credit and purchasers need the same protection via any cc provider approved reciever of funds!

As a consumer you also have to remember you have your legal consumer rights as well....
So S75 should be the last chance salon. NOT the 1st port of call.
So as far as the FSA go S75 needs a total revamp to bring into line, to ensure it is not abused by people who are simply to lazy to do what they should.Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -

I finally have some updates on this situation. As I imagined a couple months ago, it was always a bit of a longshot, and I think I've hit the end of the line on this one.
The "DISPUTE AMOUNT" transactions were actually just markers which they put on as soon as they acknowledge that they are dealing with a dispute. They aren't actually debits or credits, and don't affect the actual balance - but just show the amount.
I received a letter (this is all with Aqua fyi) after having called them to start the dispute - the letter requested that I send in supporting documentation, but wasn't too specific about what was needed. So I went ahead and printed off the whole history of the conversation from Ebay, along with the details of the transactions on Ebay and Paypal. I included a small letter explaining the situation again, and pointing out the abrupt discontinuation of any communication from the seller after the item had been shipped back.
That was about a month ago. Just the other day, I received another letter, stating they had not received the information/documentation they requested. So I called them today and explained everything, and the person I spoke to was able to pull up my file and see that a note was there, that I had sent in a letter - but nothing more specific about any documents being sent. Anyway, she confirmed that she understood the details of the dispute, and informed me that if I didn't have any actual proof (i.e. Royal Mail receipt with tracking number and delivery confirmation; or actual message from the seller confirming receipt of the returned item) then they would not have enough evidence to submit the dispute to MasterCard. No matter that the seller has stopped all communication, and that I do have documentation of this, along with the advice from Ebay. So basically we've hit a dead end. I've given negative feedback on the seller, but it seems like there will be no other ramifications or outcome here. I guess that's what I get for being cheap and not sending the item back registered sign for delivery. It just drives me mad now knowing that this seller can go ahead and continue being active on ebay and paypal, with only the one little negative feedback on their record from me, and there's nothing else that can be done about it.

Not had time to go back through all posts but can you not go via Ebay on this.
Or do they again need proof of delivery.

I originally started by raising a case on Ebay directly - but since the max time had passed since the original purchase (45 days if I recall?), they wouldn't do anything except write me a long sympathetic letter. Their advice was to go to the card company to do a chargeback against the paypal transaction.0

Sorry to go off on a tangent, but if you use Paypal linked to a credit card to make a 'personal payment' to somebody, will your card class this as a cash advance or as I suspect do they not see the purpose of the transaction?0

Paypal transactions always show up as purchases on my statement, regardless of the paypal payment reason/type.0

A few years ago, but I had a chargeback against a Paypal transaction, whch Paypal contested but eventually still went through and I wasn't banned.....0
