Claiming costs after a court case

  • Witnesses may be entitled to some expenses to attend court, - but your mum didn't attend court, so the answer is no, for her.

Defendants don't get expenses to attend court.
Cash not ash from January 2nd 2011: £2565.:j

OU student: A103 , A215 , A316 all done. Currently A230 all leading to an English Literature degree.

Any advice given is as an individual, not as a representative of my firm.

What was the court judgement, guilty or not guilty ? I assume guilty as per your plea so why should you be entitled to anything ? If the case was kicked out and the cps were given an earbending by the judge then you may be entitled to something.

I plead guilty with special considerations.

You were found guilty but because of whatever the circumstances were no points or fine were applied. I don't think you can get any compensation in this case because it isn't given because you got a minor or no punishment instead of a more major one. Should anyone who gets an absolute discharge be entitled to recompense for their ageing granny spending time writing a letter?
I also don't know why you post here because you have decided in advance you are "entitled" to something and it doesn't really matter what the responses are(even if some are gratuitously rude).

I haven't "decided in advance". I'm asking for genuine legal knowledge, not people's personal opinions on the matter.

Then you need to seek professional advice.

These forums, and most other forums, will only offer the opinions of the poster.

    From the forum rules...
I want to give advice, why can't I?
If you're discussing a topic you have a professional knowledge of you can make that clear, but please don't give "advice". We don't have the resources to check what you say is correct and would hate to hear something had happened to someone reading it.

That is not the answer to the question I asked.

You were guilty of an offence and admonished, admonished is still guilty and it will still be on your record for ever more. No you are not entitled to costs.

Although my mother did not appear as a witness in the courtroom, it took time to write the witness statement used in court and to prepare for the case - is she eligible to receive work time lost for this time taken?

This part has to be a windup.

That is not the answer to the question I asked.

Why would the magistrates court (or any court, for that matter) find my not guilty if I have already plead guilty?
