02 phones4u contract not activated

    Surely due to their terms saying activation will take no longer than 72 hours they wouldn't be allowed to manually initiate activation after this time without notifying us?

    I don't think we'll be returning the phone at our own costs, why should we, though if they'd like to say there's nothing they can do apart from collect the phone from the registered address then that's fine (though why at that point they can't do anything they could possibly need me to do in store I'm unsure?).

    She paid a upfront fee for the ip
    no other moneys taken from bank.

  • The same thing happened to me, I went direct to apple store got a iphone 5 on a £26 pm contract in september and paid £300 upfront for phone. No service for 3 days, contacted 02 who contacted and Apple both had no contract on their systems.

    Told by 02 rep as far as they were concerned no contract formed. over 4 months later on sim free contract.

    I would leave it and see if they contact you. If they come back to you then set up a new contract but don't go out of your way.

    its a signed contract, so yes they could in theory do a manual connection. As the phone has not been paid for they could also bar its imei
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    It has been paid for, regardless of if it's a discounted rate or not I paid £99 for it, the network pay the rest so they would have to chase them for it.

    BTW just curious, what is a manual connection averse to the normal procedure when you buy a contract?

    It's the network who own the phone though and would chase you for it. On paper the £99 was a deposit towards the cost of the phone as there was not enough profit in the contract to cover the full cost of it.
    Hence the options should it come to light that a phone is owed back will be return it or pay whatever the value is of phone at point of sale.

    As you've tried to resolve the issue to no avail if it was me I'd be tempted like you just to get a rolling monthly contact and wait it out for now

    I think it's phones4u that owned the phone. The OP is now the owner.

    The phone for £99 was part of the contract which has been signed. Until the network starts providing a service there's a bit of a standstill.

    Having looked at this thread earlier and come back to it, my opinion is that the OP can use the phone as they see fit. It's up to O2 to start providing a service which the OP has agreed to pay for.

    My understanding is that O2 supply the package ie phone and service and Phones4u being the broker take commission.

    When service is provided the contract concludes when the service starts.

    However if for some reason the contract can't be concluded then all bets are off and both parties have to be put back to the position before the contract ie. the OP gets the £99 deposit back and O2 get the phone back.

  • When a phone is supplied by a retailer like phones4u or Carphone warehouse it is those companies that supply the phone. The networks pay them a fee that includes the cost of the phone.
  • As a quick update we returned to the phones4u shop, they insisted we get a full refund and start the process again. After a little talk I explained how others had been felt with and we walked out with the £99 phone and a 12 month sim only (we had to stay with 02 with the same minutes etc) but overall the full contract will cost less than the retail price of the phone! Bargain of the century! Cheer everyone for your input!
