how would they make the mistake? Any ideas?

Yes. A human being who is responsible for inputting figures to payroll has missed a figure out. I've had overtime missed off in error. A colleague has been wrongly paid for unpaid holiday taken. Mistakes happen!

  • Not really an illegal deduction, just an error in missing off the loan amount.

What would you suggest they do AP007? Send in the police?

Evidently a simple mistake has been made OP, treat it as such and be constructive in getting it resolved. Flying off the handle will just make you look unprofessional and somewhat desperate. It's only £100 and not worth losing your job over.

  • I'm not sure what part of this you're not getting. A mistake has clearly occurred. Of course they shouldn't make a deduction without paying the actual loan. And I'm sure the person responsible will be mortified when they realise their mistake and will rectify it immediately. There is certainly no need for aggression or jumping to paranoid conclusions without even speaking to payroll about it first.

And as I said, if the OP cannot afford this £100 monthly deduction they really should reconsider the loan.

No I can't really afford it yet can't afford to let them "review my contract" plus I'm doing as much OT as poss to compensate the repayment
  • An illegal deduction can still be a mistake, they are not mutually exclusive
Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
  • Muscle, I recommend you WRITE a POLITE letter to your employer tonight or tomorrow morning, informing them of their mistake, explaining that this leaves you in financial embarrassment, and give it to them.

You don't sound at the moment as if you would find it easy to have a polite and respectful conversation with your employer!
Ex board guide. Signature now changed (if you know, you know).

*Whoosh* that is the sound of the point about the police going right over your head. Have you got some constructive advice to give or are you going to keep going on about it completely irrelevant points and making wilder and wilder claims?

At the end of the day not everything is a fight and not every error is due to malice. The OP needs to be constructive, calm and collaborative to fix what most people can see as a very simple error.
