    CANCELLATION AND REFUNDS

We charge a fee of £69.95 for providing the service of acting as a finance broker. We specify the fee as part of our communication with you. If You do not enter into a loan offered by a lender or financier within the 6 months, we will refund the fee less the £5 brokerage fee provided for by the Consumer Credit Act 1974. Refunds must be requested in writing to avoid repayments being sent to a wrong address. If a lender or financier makes You a loan or finance offer, in addition to the fee We may also receive a variable commission from the lender or financier (more detail is available on request) and You agree that We may retain it.

Under Financial Services (Distance Marketing) Regulations 2004 you have a right to cancel your application within 14 days of receiving our paperwork to receive a full refund. If You wish to cancel your application, You must write to Davenport Black notifying us. In this event We will refund your fee within 30 days of the date on which We receive your written request to cancel your application. Any such requests should be made to: Customer Service Department, Davenport Black, 268 Bath Road, Slough, Berkshire SL1 4DX.

Quite clear what you have to do. Their website doesn't even try to hide the fact that they are a broker. T&C's are quite transparent for all to see.

I havehad nightmare of day with this company today Right Financial. No matter how you dress it up its a scam and you are incorrect about knowing about the fee when they call me a girl called Sabrina she did not mention the fee of £69.95 and I unfortunatley like many others beleived this to be actual acceptance for a loan (sales people they know how to dress it up) I thought Im savvy as been in industry for years and know all there tricks) However not this time. Yes I am desperate and was knocked back by my bank as I am only part time so applied for small amount over longer period to get bye. Anyway I done what she asked was all too simple now that I think about it. I then went to email Welcome Pack and what I had agreed to was them charging me £69.95 brokers fee to look for a loan for me. WHAT?? I could do this myself and all morning my phone has been constant with even more brokers debt help and especially Pay Day Loans. My credit is not the greatest however these people play on this and If a genuine company why use sales tactics to falsely lead you down the garden path. Then they called me back offering a further loan (in the mean time I was looking for a contact number to cancel as it says you are within your rights 14 days) Guess what the number
0844 880 4285on hold still not got through and probably costs a bomb. Anyway I explained to the next person I was falsely lead to believe was for a loan and there was no mention of fee untill looked at pack girl was in shock and said ill pass you to manager low and behold was the girl who sold me it. She admitted sorry there is a fee i thought you new that and dnt worry we wont take payment today?? I said payment for what I can get a pay day loan myself and the fact that the other girl said the payment does not come out untill 18th?? You havent even asked me when I get paid and this is surely going to put me into debt with bank. After long period of trying to dress up she said okay I can give you number to cancel. I said ok thank you which was 08446523880. Thanked her and thought finally. Guess what constantly engaged and a long thought of Im in trouble here this is a SCAM. Guys I have searched online and found this information freephone phone our consumer helpline on 0300 123 9 123 or 0800 023 4567 this is the website I got from Financial Ombudsman Uk Complaints all info there guys. They take your details and are very aware of this company working under A Davenport Black Company and send the actual company a letter asking them to refund the customer in my case this will hopefully stop the payment. The company by LAW need to reply back to your email address with a decision within 18 days and if they respond saying no then they have sent me an email attached a form and you can forward this on to them and they will get on to them. PLEASE use this i feel a bit better and hope it works. Ohhh and by the way again another call after spoke with FBA ( this has been my own fault I did apply for what I thought were loans but for some reason all going through Right Financial) called me again I said listen this third call today Im amazed and explained the situation this time girl seemed genuine and was shocked with what I had went through I asked her as confirmation what is the cancellation number for your company I just want to check this against what Sabrina gave me and yep it was different (she just wants the sale in my eyes) She said she will pass to manager and listen in to all calls and was shocked that she hadnt extended the date and gave me wrong number. So good luck with number guys but heres cancellation number within 14 days 08446923880. My advice steer well away. Thanks (rant over):T

Not financial as my industry clearly as in sales background but no longer and this is only 1 persons bad experience letting people know my experience I thought this was a forum to do so?? Have you complained about any of the other numbers that have been previously posted?? why only this one. If I have offended you personally then I do apologise this was my first ever post and rightfully saying what happened .If anything the numbers are to help to either cancel or contact FOS without costing them anymore "if" like me are in a bad situation and I cannot see why you would have your back up for people that cannot afford the fee and are looking for advice unless to help them??

FOS will only get involved when you have exhausted the company concerned's complaints procedure.

As Apples2 said, you need to write a letter to request cancellation and refund of the fee - not phone, email or send smoke signals.

A word of advice though, if you do get round to writing to request a refund, use sentences and paragraphs otherwise they won't have a clue what you are on about.

I picked on yours as it is such a difficult post to read. This isn't an English Test but if you do want to offer advice, please make it clear and legible.

I have mentioned on many posts that phone numbers are worthless and your posts even said as much, but you still posted phone numbers.

Lets look at the Terms and Conditions (I can see this without applying for anything)

The point is, just do what it says. If you don't get a refund after following the very process THEY ARE TELLING YOU TO FOLLOW, complain to the FOS and let them deal with it.

I wrote the post in anger if I am honest and can only apologise if you cannot understand it. However the information you are giving me I did not receive until after the call. At any point also I did not apply for a loan with this broker. Albeit I was stupid (i admit) to believe I was proposed an actual loan and thought this was what I was signing up to. This post is to let anyone no if they find themselves in difficulty they can contact them As I said before have never seen any of your previous posts and I am new so unaware of what to write and what not to write but surely if this happened to you what would be easier calling the company ?? who prob make some money back from the call or write to them for them to say they never received!! please do respond? If this was such a bad post on my part then please report me I do not mind as the post will be taken down if I have done something wrong. (I'm not complaining about what CLEARLY states in the policy I'm rightfully upset in the way I was signed up for it) Unlike others I have no funds in my account on the date they are taking without my acknowledgment and have no time to send letters to something I was unaware of in the first place and thought this would help others like me) Again I apologise if I have upset you and I cannot imagine why? But politely will be sending no further posts to you as its clearly a no win situation. Thank you.

You really don't understand simple instructions do you.

It doesn't matter if it is easier to phone - their T&Cs (which you agreed to when you signed up for their service) clearly state that any cancellation has to be done in writing.

The funds were also taken with your authorisation - you gave them your card details and then clicked the accept button to agree to them deducting their fees from your account.

If it happened to me id write to them requesting the refund and if no response within the 8 weeks then I would contact the FOS.

Oh and niki you havent upset anyone at all.

I suggest since you were hoping for a loan then you l;ook at your day to day spending eg buying a magazine, drink etc, cut back on things you dont need, only buy what you need from the supermarkets.

    I'm really sorry to bump!

This has happened to me today. Off my face on pain meds and I didn't realise what I had done until my husband berated me for it (rightly so!) I'm going to write to them to ask them to refund the money and to cancel the application. Just hope that they don't take any more money as we don't have alot of money as it is. :(

LadyMorticia - its very unlikely that they will take more than 1 broker fee from you.
However if you want to be certain you could always contact your bank and specifically tell them that you haven't authorised any further payments to this company and ask them to ensure no further payments are made to this company.

When/if you do get the refund from them come back and update - at least that way others will know it is possible to get the money back by writing to them.

    Thanks.

They tried to call me but because I have severe anxiety, I cannot use the phone most of the time. When I'm off my face on pain meds, I don't seem to care and can manage it a bit more but then I don't want to get myself into a worse situation. Catch 22.

I'd prefer to email but I can't find an email for them anywhere. :(
