That was the gist of the reply DVLA sent me.
Thanks. I believe you.0 -
However - - - Trading Standards couldn't believe that the company used signs with wording like that. They are vigorously pursuing the matter.
We will wait and see the outcome.
And today I found a private car park warning of fixed penalty or clamping!!!
Despite a ban on clamping on private land being in force since 1 October 2012.0 -
Who at the DVLA fobbed you off?
Did you mention to them the implied statutory authority that is implied by such language and that it blatantly contravenes BPA code of practice, which in turn would throw doubt on the PPC's compliance and hence their right to access DVLA records?
To be fair the sign doesn't really state who owns it or who is claiming to be issuing the 'penalty'.
Glad to see TS are slightly more switched on about it than the DVLA.Je Suis Cecil.0 -
I told you what the dvla would say, they refer it to the bpa, they don't see this wording as within their remitWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Hi ManxRed. It was a guy in the 'Vehicle dept' at DVLA who advised me that BPA look after problems like that. DVLA only get involved if BPA tell them. Typical passing the buck tactics.
Your comment re: the sign doesn't show who is claiming to be issuing the 'penalty'. In my original post at the head of this thread you will see that ''They (AEJ) have the usual company signs (of which I have pictures) stating what constitutes an offence.'' The smaller 'penalty/fine' picture I have shown on here is in addition to the larger sign. My thinking is that the smaller signs belong to AEJ as they state the car park is under their control. Therefore they are aware and responsible for all signage.
Hopefully Trading Standards will now do their stuff0 -
Two weeks on and nothing has yet happened - signage is still in place at both locations.0
-
Six weeks gone by - still no action. Signs still in place on retail park.:(:(0
-
God, anyone would think that we believed that the DVLA were - by ICO definition - Data Controllers of all our RK data or something and that they ought to take action on breaches of this rather than leave it to some third party industry club who have members with criminal convictions.
Oh, hang on....Je Suis Cecil.0 -

10 weeks on and TS appear to have vigorously done nothing - the signs remain.0 -

AEJ Management Limited have sent their painter/handyman to sort out the signage.
