Scammed on eBay - PayPal will take my money

While Paypal will refund the buyer, there is, however, nothing to stop you sending a recorded delivery letter to the 'business' address telling them that you are disappointed to find a Paypal chargeback has been made regarding the purchase and that they need to pay for the phone or else you will take them to the small claims court. Remind them that you have all the emails and texts which WILL be evidence in court.
I would give them 14 days to contact you and arrange payment by BANK TRANSFER (ONLY) before you file for your losses with small claims court and, if you have to do that you will also report them to the police for fraud (the crime reference number will go into your court claim). Remind them in the letter that all costs incurred by the action will be added to the claims and will be payable by themselves.
Look at moneyclaimonline. Mega easy to do and usually scares them into paying up and might stop them doing it again in the future. And do it. For the sake of the £30 or whatever it is to file, they cannot get out of the fact they bought and arranged to have the phone delivered to themselves at that address - it just means it'll take a bit longer for you to get the money, that's all.

How come you get 6 months? I thought they could just pass it on to a debt collection agency, thus adding fees after they've made a reasonable attempt to ask for the money.
Or for £340, they might take you to court as it's a reasonable amount.
I'd try and find the money to put into your PP account!
I read that they take six months on an anti-PayPal site. Sort of makes sense as using a debt collection agency would be last resort for them.
I will, if it comes to that, enter a dialogue with PayPal to explain my position and that I will pay them back once I have sufficient funds, but obviously I'd rather not have to do that if I can help it.0 -

They are a big company with lots of money, so it is frustratting that I'll be the one that loses out, but yep, sadly as Soolin says I didn't realise that sending to an uncomfirmed address was against PayPal's seller protection policy.0 -

Thanks I will do exactly this. Thank you. Hopefully it'll work out. As you say, I have their phone number and their address. This person has effectively stolen my phone and cost me £340.
The credit card company of the person who was hacked into, may well do an investigation of their own, so I'll also try to get in contact with them.0 -

Someone, "the buyer", hacked into an individual's eBay, PayPal and email accounts. Well, they either hacked into their eBay or created a new account in this individual's name.
They bought the phone via eBay using the using the individual's PayPal account and was in communication with me using the email address attached to the PayPal account and the eBay account.
It certainly pays to keep your wits about as a buyer or seller. If selling something for a high amount never post the item to an uncomfirmed address!0 -

PayPal also charge a pretty hefty amount in fees when you sell. Bring back cheques!
I think too, that they charge me for the chargeback. About £14 or something. Just to add to the misery!0 -
No, they follow a set of clearly printed guidelines that even OP accepts he ignored. We are now trying to work out if there is anything at all OP can do here.

maybe in this case but as a seller YOU WILL NEVER WIN A CREDIT CARD CHARGEBACK WITH PAYPAL,
in my eyes paypal are a necessary evil for ebay but bar that they should never be used,
New someone who sold a $5400 domain via paypal (stupid i know) guy charged back, and yeah the chap, (only a young lad) was gutted.0 -

Sorry, you are wrong. A seller can always win, and will always win IF they follow the rules.
If you read the sticky you will see it is not rocket science, and what is more, the best protection is absolutely free!0 -
I'm struggling to sympathise. Surely one would check the full terms out before posting something worth hundreds?
The police may be your only recourse to get your money back in this case.0
