I would have thought Daisy's draft is excellent. Cleverly written so that it doesn't sound as if it has been drafted by a solicitor!0

i will never get this in to FM and have him look at it now - he will be leaving in 15 mins. Will be more like Monday.0

So move this quickly now? Job wont start until March, formal letter being sent on Monday.
Yes the offer was via email.
Okay, if some things are off, correct them and repost the letter so I can see it before you send it.
Yes, I want to speed this right up, to see if we can get the job offer clause removed, as I don't want you signing something that could come back and bite you later!
Once we have a comp ag that has the offending clause removed (if they agree, which they might not) then we can slow it down again. For the moment I want to put some pressure on them so we can try and get the best deal for you re the wording of the compromise agreement.
Edit: Please try to change as little as possible - it needs to be factually accurate, but it has been drafted in this way for a reason.

Ultimately the new job is far more important than getting a CA out of your current employers. Realistically you will do well to end up with the equivalent of a month's salary (not counting the notice pay which, arguably, they would have to pay anyway).
If you can get both then great but it is an absolutely standard clause requiring you to confirm that you have no offer of new employment at the time of signing.
I would strongly suggest you follow Daisy's advice and get the letter in ASAP.0 -
i can ring him before he leaves work ask him to wait but i will have to be quick!!0

Eh?
Why then were you asking about various clauses from the agreement?
Maybe I'm missing something?0 -

they have said my main part will be billing etc via sage. the job is currently a job share he feels isnt working and if they had a full time person there will be time left over for "extra" things. i will be in support to everyone basically (again!!) why me??
at present i dont think i am really in a position to argue about it because my current job will be over within days now.
there are appraisals/performance reviews - something the young boss wants but some of the staff arent interested, he says ppl just come and do their jobs. he has taken over from his parents in his late 30's i'd say, another ltd company - bigger then my current one.
One thing I would say is that if you accept the job, you are also going to have to accept that your new employer is likely to have similar expectations to your old employer, in the sense that you are being employed to provide admin support to several people. The law has changed since you started your current job. Now employees have few rights and very little job security for the first two years. So if you get into this same situation with the new employer you won't have any bargaining power at all, and the chances of you being dismissed without a leg to stand on are now vastly increased.
Just saying that if you take the job on, you need to know what to expect.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

a few worries i have.
the "cannot be under offer of another job whilst signing this agreement" i am not exstatic about.kelly_borntoshop wrote: »Dear FM
I have now had time to think about it and I have decided that I would like to see a copy of the compromise agreement so I can consider your suggestion properly. I know you did read it out to me but it was very legal and I cannot remember what it said. One thing that does stick in my mind though is that you said I had to sign to say I don't have a job offer. I must say I think it is very unfair to ask me to leave and at the same time telling me that I can't look for work until after I have signed the agreement, which is basically what you are saying. So I do want that bit taking out as I don't think it is fair.
made a couple of edits but the red bit didnt happenhavent seen, nor heard their agreement
Okay, we need to back track a bit as I am confused.
If the bit in red didn't happen, where did your comment about the clause "cannot be under offer of another job whilst signing this agreement" come from?I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0
