Suspended During Grievance

You remain suspended until the disciplinary hearing or they confirm to you there's no case to answer.
All the best with the other interview feedback - Daisy has been doing her normal sterling job so I won't cross post with her. x*** Thank you for your consideration ***0 -

Go ahead, I am always happy for 'common sense' input (I'm a lawyer, I tend to get focussed on the legal stuff...)

Yes daisy, some of what you are saying (basically the non legal bits!) are what I'm trying to say but I can't put it as nicely as you!! You do have a lovely way with words!!0

Hi Kelly, yes you remain suspended until the disciplinary. That means you continue to be paid, and it gives you time to think about what to do about references, and also to keep job hunting if necessary (let's hope it's not).
Yes, they may well view the threat to wipe the work as gross misconduct, but you'll be explaining (nicely) that it wasn't really a threat at all, just blowing off steam out off work, as people do.
But let's hope that they may be open to coming to an amicable agreement with you to avoid going through the disciplinary process. They don't have to, and you don't have any right to demand this, but nevertheless, there is a reasonable possibility that they might be willing to go down this route.
One step at a time.
Good luck with the grievance tomorrow. Stay calm, be nice, eat humble pie, stick to the grievance procedure, and keep the rest of your cards close to your chest.
Oh, by the way, just on the off chance that he raises the possibility of a deal tomorrow - just act innocent, say you are not opposed to the idea in principle but you'd like to think about it, and mention in (in a low key way) that if you did agree to their proposal, you would be want a reference to be part of the deal. But don't raise it unless they do, and don't take the lead. Just keep things smooth, and come back here and tell us what happens.

As do I, Daisy (Well, and protecting the Company from management wanting to rush things...) I'm not legally qualified, but a pan-European HR BP and spend a lot of time each day advising managers etc.
But that's by the by. I know HR people are not much liked on the boards, which is why I tend to lurk. Saw SarEl come and go, return and leave again. It puts me off trying to help!
And before I digress - Good luck with it Kelly. x*** Thank you for your consideration ***0 -

Apologies! I didn't realise you were one of us :AI'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
What if they mention the disciplinary today? Do I talk or do I say hear this later?0

You take a note book, you let them run the meeting, you answer their questions calmly and politely, and you write everything down.
They shouldn't raise the issue of the disciplinary meeting, as it is a separate issue. If he wants to talk about the specific allegations being made in the disciplinary you keep it neutral and none specific - in other words you say things like, 'I was under a lot of stress but I believe we can work through this, if we all work together' or 'I believe I still have a lot to offer the company' or 'I accept that CD and I may not always agree, but we are adults it should be possible for us to work together'.
If he pushes you to answer specifics to do with the disciplinary, then you just say somethings like 'in her letter CD told me that the grievance and the disciplinary must be kept separate, so I am not comfortable about talking about that'
But I don't think he will raise the disciplinary issues, I expect that he will stay well clear. He has been put in an uncomfortable position, as he is being asked to hear a grievance meeting against CD who is his superior.
Good luck with the meeting, and fingers crossed for the new job too.

incase is makes a difference there is something i havent gone into.
after letting CD know about the pressures and stress and it not being addressed, the following week we were packing up and moving from a small unit to a considerably larger unit which has 2 floors.
i was concerned as to how the front of house would work as both myself and CD are upstairs in our offices - the foyer is empty, there are no additional staff and i would not be able to hear the door etc. i was also concerned with how despatch would work - there are no computer systems in effect for this and mostly it is still being done on paper. i asked who would be doing the "running around" (chasing FM with orders, up and down with delivery/despach notes/messgaes) and i was told it would be me because i am younger than CD.
it was december and dealines had been brought forward a fortnight to allow for xmas holidays. a couple of days after the thing with my CD she informed me there was no broadband in our new place (without it i am at a huge disibilty).
there was no closure at all even though FM recommended it.
after coming back after xmas we had some dongles where arent very good, had to get an IT guy in and this guy managed to hook my machine up through the main phone box, he hooked me up through the phone line so depending on how much data being used it knocked off the phones which i was reseting up to 6 times a day. some of the files i send are 10mb so that was a problem and had to wait until close of play to send. since i was the only one who had half decent connection i had extra tasks when needing a connection to complete. all emails were coming to me, extra printing and running about. i also had to step in with the technicals and sourcing the equipment on getting the broadband going since apparently its not something the company normally do. i guess i just snapped.0 -
the week before the thing with CD i was told to post a job in the jobcentre. FM asked CD, CD asked me.
I did this. there were about 300 applicants in the first 2 days, FM said to take it out then and i probably should have but for what ever reason i didnt get round to it.
CD suggested that she took them home to look at when she posted my job and looked at them there. so i did, every night.
that week MD came 2 days. at close of play on the 2nd day he was there when i was sifting through them, they were meeting with the guy from the bank and it was kind of a quiet task to do. i dont know if he perhaps said something but the following day i was in trouble with both FM and CD. i said i had been so busy on my own, i was sorry, i had been working on them at home and not in work time, i didnt mind and thought it might give a better selection. i immediately took it out, i know if FM isnt happy then i am in trouble, thats the only time he has ever addressed me. i was slammed by CD for the amount of ink and paper even though she suggested taking them home. but fair enough.0
