car crash advice

Hi

I really need some advice. My car was hit on Friday, he was going about 25mph behind me, I stopped at the round a bout and he went straight into the back of me, pushing me into the round about.

He pulled over, his headlight was smashed and there was extensive cosmetic damage to the back of my car ( boot is pressed in, crack down bumper and lamp not supported).

I have a witness and he admitted liability at the scene but when I called him later on he refused to report the incident or give me any insurance details.

I called up my insurance and reported it, now they are sayng that the likelyhood of my car being a total loss is high. My car is ford focus 2000. If this happens I will have no car, what will they likely pay me as a pay off for the car and will I have to then pay my insurance up till sept 2013 renewal as I pay monthly? Am I best of just living with the expense of repairing the bumper and living with the boot damage?

Or should I go down the route of writing it off? I don't know wether to cancel the claim or not, it seems so unfair that I will be worse off?!

I have never claimed before so I am not used to these things.Just to add my MOT and tax are due at the end of Jan so I really don't know what to do.

Thanks

Number plate as said, get your witness to make a statement and take all the facts to the police

    Police.

A drunk driver wrote off my (parked) car a few years ago. As I had the reg number and they were insured I claimed for the value of the car, the excess and a loss of use claim.

You poor thing! Please get onto the police at once to report the accident and make sure you tell them about the abusive calls too - also, I'd suggest you see a doctor asap as you are likely to have given your neck and back a nasty jolt at the very least.
Take care of yourself and let us know how you get on.
    Best wishes

Call the police and your insurance company. DO you have his license plat number? That is all you need.
  • Whatever you do, please contact the police! I hope you are ok :o

You are both guilty of "failing to report an accident" to the police. You should have got his name, address, tel no and insurance details before leaving the scene. That said you obviously got some of these details and you have a witness statement. Contact police and tell them he is refusing to give you his insurance details and they will almost certainly pay him a visit on your behalf.

Call 101 right now and talk to them. I have had to call them about both a car break in and a non-fault accident and they are brilliant. They are the non emergency line so you won't be wasting their time. You can't be harassed about this by them, it sounds like they are doing so because they are on the defence about something so you need to sort it right now before things escalate.
