DRO Application Info Please

    I do have a question mainly for the National Debtline person.

    If the time is averaging 9 weeks to process these applications, won't the balance of the debts increase, some of them by quite a lot in the 2 months? Making the form pretty much invalid as none of the figures will match and you can still be pursued by any amount that isn't on the DRO form and also your asking for a copy of the experian credit report to be dated within a month, that will be out of date too, a lot can happen in two months.

    Just wondered as obviously I would want all the debt amount covered.

    Hi Jon,

    At the end of the 9 weeks your intermediary will contact you to ensure that we have up-to-date balances to put forward within the DRO. It's a very good point as it's vital we include the full of the amount of the debt so that it's included within the order.

    If you are near the £15k eligibility limit this could be a problem as a delay of 9 weeks could take you over the £15k but if your debts are much less,you twill just need to provide updated figures when the application is ready to be submitted.

    As for your question re Payplan - the consensus seems to be that these days they are not the best for impartial advice due to the way they are funded.

    Also I do have a question.

    The reports for the credit agencies are they just to see if you have forgotten anything? As I have people writing to me about debts that do not show up on any of the 3 reports from experian, equifax or callcredit. One of those debts that doesn't show up I have been paying plus others like council repayments(not council tax).
  • I haven't dealt with payplan for a few years so cant give a current opinion but there seem to be a lot of posts questioning their impartiality as they are funded by creditor donations.

    And yes the credit reports are a tool to help you check that you haven't forgotten any debts as if you have forgotten one that takes you over the £15k limit, that could mean your DRO was revoked and you'd lose your £90 fee.

    There will be debts that are not listed on any of the reports but you must still declare them as you have to list all your debts inc benefit overpayments etc.

    If debts have been forgotten and there over 6 years then they won't matter anyway would they?

    What about bills that have been forgotten and aren't showing up on a credit report either, whats the standing there then if it takes you over 15k?

    By 'over 6 years', I assume you are referring to statute barred debts which can be left off but you must be very sure they are stat barred.

    There isn't a lot you can do if you have genuinely forgotten about a bill and its not on any of the reports but if one does become apparent to the DRO Unit during the 12 month period in which your debts are frozen, and it takes you over the £15k limit, your DRO is likely to be revoked. This is why you must do all you can to make sure you have all your debt info as whatever goes on the application is your responsibility.
