Hi, i'm 11 months into a 24 month contract with the above shop (can't bring myself to call them a supermarket).
The phone speaker is not working properly and it is very difficult to make out what someone is saying.
The mouse button is broken which makes moving the cursor is nigh on impossible and takes utter ages if it works at all.
Tesco say i have to send them the phone, buy a £9 PAYG phone from them, wait till my phone returns then go and ask for a refund of £9 and hand back the PAYG phone. This would involve me travelling about fifty miles and take a good four hours of my time.
I am not in very good health and need the phone with me 24/7 in case of emergencies. They cannot provide this service. I asked them to cancel the contract, they will not do this unless i pay them 13 months worth of charges. "its all in the contract" they say, but do I have any rights under sale of goods or anything to fire back with?

You have no right to cancel the contract.
What phone is it? Dealing with the manufacturer might be less hassle for you.0 -
Its good of them even offering a loan phone to be honest, other networks wouldnt normaly.Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

Given that the phone is so important to you, it would be worth you buying and keeping a spare one. If it's not a Tesco phone, you'll need an unlocked one to work with the current SIM.

Thank you for the replies people, i get very worked up and can't think straight when something like this happens.
Its a blackberry phone with speaker and mouse button issues, can't use it for anything but phone today which is annoying as i have to read emails when i am away from home.
I'm just so sick of being monopolized by tesco. this phone is the last thing i will ever have that's related to tescos. I was so irate with the way the woman on click and collect spoke to me yesterday that when i caught up with my mother who was shopping in the store and explained what had happened we decided to leave her trolley full of shopping and walked out with me.0 -

But what happened in store yesterday has nothing at all to do with the fact that your blackberry is getting worn out, does it?
If you have had 11 months use of your blackberry, then you can't really expect Tesco to replace it for you, nor to cancel your contract - you knew it was a 24 month contract when you signed up. I think they have offered you a pretty good compromise to be honest.
If you need to be able to pick up emails etc while your phone is being mended, buy a refurbed blackberry such as this one http://www.ebay.co.uk/itm/BLACKBERRY-8310-CURVE-MOBILE-PHONE-UNLOCKED-WARRANTY-/280820258221?pt=UK_Mobile_Phones&hash=item41623115ad to use pro-tem, then either keep it as a spare or sell it on again when yours is returned.I try not to get too stressed out on the forum. OP - Tesco have treated you no differently (if not better) to how you would be dealt with by any other mobile phone provider.
Your phone is 11 months old. They have offered to repair it and in essense, "lend" you another while it is being repaired.
Do you think any other faulty good, 11 months old, would be instantly replaced? No. It would be sent away for repair.
You have no legal right to cancel your contract, so please, shake off this notion that you are hard done by, or being treated unfairly by tesco!0 -

Personally I loathe Tesco, but in fairness to them, they've hardly monopolised you. You have a sim for a phone service, which hasn't been a problem.0 -
Just a wee note to say, let them send it back. You will probably get a reconditioned phone sent in it's return. We had to do this with my son's blackberry too. They all come with new housing and look like brand new.
It's always a good idea to keep a spare phone in the house for emergencies anyway.4 Stones and 0 pounds or 25.4kg lighter :j0 -

Have you considered contacting Blackberry? Sorry if you did and have written that, I didn't manage to read that part if its there! As an electrical item you should have a warrenty which I'd imagine would be with the people who made the item rather then who you bought it from, not saying it will be different but could be worth checking with first.
And OP, it is a good thing: a month later and you'd have no rights over getting it replaced at all as it would be out of warranty. At least this way you get a brand new handset (or refurbished but as good as new IMO) to take you to the duration of your contact. If your lucky enough for that to be up after 12 months it'll go for all the more if you sell it on ebay.0
