Phone has broke 5 times (4 new phones) can I cancel 24 month contract?

Hello all,

I have a 24 month contract with Orange (I am about 5 months into the contract) with the Orange San Diego mobile phone.

During the 5 months I have had this phone I have recieved 4 replacement phones for a fault that has happened times (it has just happened again).

The fault is the top power on/off button keeps getting lodged after I have has the phone about a month which make me barely able to use my phone as I have to use this button to unlock my phone and I have to use a penny or something similar to use it when it has broke.

I don't wish to ask for another San Diego, as its obviously a fault with the phone (other forums have noted people having this problem, also my friend has had this phone for 6 months and it happened to him for the first time last week.)

Does anyone know what way I should go about this? Should I ask to terminate my 24 month contract or ask for a different phone in place of the San Diego on my current contract?

Any help will be greatly appriciated. Thanks all, and sorry for the mega long paragraphs!

    I suspect that you will not be able to terminate your contract as the phone and contract are not linked in that way (they effectively "give" you the phone/charge you a subsidised rate, but eith the cost absorbed into whatever rate they charge for your tariff). The best that you could probably expect would be a replacement phone that is not the San Diego if you complain enough.

    You cannot terminate the contract, but you are in a position to ask Orange for a different handset with similar specifications. However, they are likely to refuse and in this case you'll have to sue them.

    You can cancel you contract at any time, you will just have to pay it off.

    A faulty phone is not reason to terminate a contract without penalty.
