Fine for parking in disabled bay

I have recently recieved a fine for parking in a disabled bay with out displaying a blue badge. I was in my works van making a collection from a store and parked on a blocked paved area next to the disabled bay, the van is covered with the company name and a sign in the window states I was loading and un loading and had the hazzard lights on. The wheels of the van was just over the line into the disabled bay, and I was parked there for a total of 7 mins. I contacted the parking company , uk parking control, and the operator looked at the photos and said to me that I should not have got the fine and I had to appeal online, which I did. They have since written to me stating that the parking charge was issued correctly.

Can anyone shead any light on this please

    But it is a works van, so inadvertently he's probably done the right thing, so OP as long as they are writing to you just ignore them
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    :money:Dont worry its a scam :money:there fake invoices are well good for emergency bogg paper, one never knows when you could get caught short of the stuff. :D
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    Private companies cannot issue fines. You have a parking charge issued by a parking company that has no more claim on your cash than I do.

    Disabled parking spaces have no legal basis on private land. They are effectively just white paint on the tarmac.

    Do yourself a favor and take some time to read a few threads on this forum. You will then soon see the light.

    In case you are still unsure ..... Don't pay them!

  • My husband was fined for parking on double yellow lines in a ukpc car park for 6 mins as all the bays were full. He is severely disabled and was displaying his badges too and another guy, who incidentally was parked behind my husband on the double yellows too without badges, told the ticket guy I had badges and he ignored him. We appealed saying my husband can park on double yellows with his badges for three hours anyway and why was he singled out as all the disabled and ordinary bays were being used and they have said we still have to pay! We have since visited this carpark and loads of people are parked in disabled bays without badges (which is awful trying to get a wheelchair out of a car in a normal space at the best of times) there were also five cars parked on these yellow lines and the ticket guy never bothered them. We have very little money and £50 fine is the last thing we need. What do we do they say the law regarding blue badges doesn't count on private land. So why are they there? They said he parked outsides bay what do they expect if there are no bays left to park in? Any advice?

    My advice is to ignore them completely. It is a scam.

    The Blue Badge scheme does not apply on private land and your husband has broken no laws.

    It's not even a fine, its an invoice inviting you to pay an amount for breaching a contract. I suggest you decline their invite.

    If you want to stir things up, you can put them on notice that they are in contravention of the Equalities Act, and you are minded to sue them.

    Yes IGNORE IT.
    They are right when they say the law regarding blue badges doesn't apply on private land. What they will not tell you is that the law regarding double yellow lines also does not apply on private land.

    They breaking the bpa code of practice ticketing you, but most importantly they are breaching the Equality Act 2010 by not offering a reasonable adjustment. I would be tempted in sending them a letter before action with a claim of £500 plus costs if this demand is not immediately dropped. I would also complain to the dvla as they would release data to a company in breach of the code of practice they must abide by

    16.1 The Equality Act 2010 says that providers of services to the public must make ‘reasonable adjustments’ to remove barriers which may discriminate against disabled people.

    16.5 If your landowner provides a concession that allows parking for disabled people, if a vehicle displays a valid Blue Badge you must not issue it with parking charge notices.
