Are Mobiles.co.uk in liquidation?

Can anyone advise me please?
I've got a couple of cashback contracts with mobiles.co.uk. I sent my second cashback claim in in Nov 2012 (following all thier rules to the letter) and haven't heard anything from them, I've emailed and written to ask what's going on but got nothing back. So I wondered if they were going under. Just been looking at Companies House website and did a company search on their webcheck service and to me it looks like mobiles.co.uk have been in liquidation since 2010 and are due to dissolve in Feb 2013 - so does this mean no more cashback paid to anyone?

I've had a couple of cashback claims in the last 6 months that came through fine. They were a bit slow to start with but a bit of chasing up had them sending the cheque out quickly!

About Mobiles.co.ukMobiles.co.uk is a trading division of the Carphone Warehouse Group.
Sometimes the only language they understand is a Letter Before Action. Search the board for 'mobiles.co.uk'. I hope you have a proof of the claim sent in November.0 -
Sending in November and doing nothing until January simply shouldn't happen. The "are they liquidated" which pops up every year or so is based on inadequate research and knowledge of cashback schemes and the dealers in question.
I recommend you check what you have confirmation of receipt of your claim (in the form of WRITTEN t&c at the point of sale) AND that you submitted the correct bill etc. If you have stuffed up (and from your question that's entirely possible) it's not too late to at least ensure that subsequent claims ARE paid. If you know what you're doing (or are a very fast learner) and have the necessary proof stated previously, send a LBA and then sue if needbe. HOWEVER - the fact that you've "heard nothing back from them" implies they will claim non-receipt, so unless you have a recorded delivery record OR the November bill date is STILL within 60 days (so you can get it to them now with proof BEFORE the 60 days are up) you can kiss claim number two goodbye. I recommend you follow all the groundrules (as far as that's possible at this stage of your game):-

I sent in my Nov 2012 claim in Dec and heard nothing despite emailing them.I was told after I managed to get thru on the telephone(in itself an accomplishment) that my claim was rejected a month ago as it did not have all details.As I was not informed of the decision until after the 60 day period I could not resubmit my claim in time. Mobiles.co.uk initially asserted that they did not send me a reply as they were not obliged to.After a few emails to the CEO etc,I was invited by customer service to resubmit my bill.So I resubmitted my bill.Less than 48 hours later I was contacted and informed they would not pay me.They were unaware of the request to resubmit my bill it was apparently an error by another team member.
Is there anything i can do?What is LBA?
Please advise-I have already spent a lot of time running in circles.0 -
LBA = Letter Before Action.
You send it before submitting a claim to the online small claims court.
You take these actions if you can prove that you submitted the cashback claim in time and if you are sure that you've done this correctly.
What details the claim you submitted didn't have allegedly?
When you knew that it was rejected 'a month ago', why had you not just resubmitted it immediately?
Re "they were not obliged to", this is arguable (although not clear-cut) and you should know this. Their 'Cashback FAQ' say clearly:Q: I sent my claim in, but I haven't heard anything from you, what do I do now?
A: It can take up to 14 days for your claim to be processed and we'll email you to confirm whether your claim is successful. If your claim isn't successful, we'll send you a detailed email telling you why the claim was unsuccessful and we will tell you how you can make a successful claim, providing you are still in your claim period. If it's been longer than 14 days and you still haven't heard from us, please email our dedicated support team by clicking here, together with you proof of submitting your claim to us and we'd be happy to look in to this further for you.0 -

I was not informed about the rejected cash back claim until I called them last week.All my previous enquiries via email did not get any replies.
I am now outside the 60 day period, is the LBA still viable?.(I have said I will take this further but they insist they will stand by their rejection.)
What are the chances of a fair outcome on the online small courts?0 -
As for why the claim was rejected, one customer service guy told me page 2 was missing and so the claim was rejected.(I have submitted page 1 on prev occasions and the claim honoured)
A second guy simply said the scan was not very clear.
Not sure which is true.0 -
As I said, you can take legal actions only if you have some proofs. If you have them, then it's never late.
However, as they don't deny receiving some copy (and you can prove this), and you still have the original, you can leave it to the court to decide whether it was really 'not clear'.
Re the second page, this depends on the statement format:Q: What information does the bill need to show?
A: All bills sent in must show your name, address, the date of the bill, the tariff and your mobile number.0 -

Totally viable - you have copies of your email attempts to get confirmation of acceptance (I presume). They did not send notification of rejection or reasons within the timescale of the t&c. They will attempt to counter those and you can't prove what they said on the telephone. Small claims courts work on probability rather than certainty. It would come down to whether they believed you and agreed that the company hasn't fulfilled its side of the t&c.
Your case isn't water tight, but if you believe that the evidence you have (dates, names and what was said as well as the unanswered emails and proof the claim was received - automatic email acknowledgement LONG before YOU found out by calling THEM weeks later that the claim was rejected AND then conflicting reasons for the rejection) it is at least worth sending a convincing LBA. When they think they're on a sticky wicket they generally pay up. I had occasion recently to push them to that point and the situation wasn't as certain as it should be - though I believe I'd have won had a needed to push the button. It also depends on how much is at stake if the outcome isn't fairly certain (though principle would generally send me into battle regardless - and I think they know it).
NEXT time take action MUCH sooner if you don't get an acceptance confirmation in reasonable time; I NEVER get it (though some of my people not only get an email confirmation but also a text confirmation) - but I ALWAYS get my money.0
