Trading Standards/Ebay

Hi.......

I would be grateful if anyone can offer me some advice on the following:

I have been an ebay member for 6 years as a private buyer/seller and in fact only ever sold a few items.
On 1/12/2012 i purchased a Ralph Lauren shirt.I was'nt too keen on it and resold it on ebay last week.
The new buyer took the shirt to House Of Fraser who apparently advised him it was a fake and he's now taking the shirt to his local Trading Standards office.
Obviously i was unaware it was not authentic and purchased it myself from another ebay seller.I cant claim back payment from the original seller because 45 days have lapsed but i'm happy to refund the new buyer.
However i am more concerned what Trading Standards will do to me?

I am really concerned so would appreciate any advice.

    Keep all records of the original transaction and point Trading Standards in the direction of your seller.

    If you have only sold one item, they will likely be more concerned with who supplied you.

    Please bear in mind that Trading Standards have powers to prosecute so if they do take it further and request an interview under caution, seek legal advice.

    Buyer sounds like a right idiot.

    You've done nothing wrong - so no need to worry. If trading standards are interested in a used shirt i would be very surprised.

    If you still know the original seller - pass them onto them.

    Print off the original listing now before it disappears.

    Not sure what part of the OP makes you feel the buyer is an idiot?

    Buyer received fake item, items is confirmed fake by a store which stocks said item, item is then passed to TS for investigation.

    Buyer is actually very sensible, because with any luck TS will contact OP who can confirm and prove where they purchased the fake from and the people actually selling these fakes on eBay can be caught and prosecuted.

    None of the above makes buyer an idiot imho

    TS will only be interested if you if you are a business seller. they can easily look through your selling history to see your sales history - if they see you have sold one item and ar enot listing other things then they wont be interested

    As someone who frequently works with TS on counterfeit queries, I can say that this information is incorrect. TS may still decide to contact the seller of the item to find out the origin of the item. This does not happen often, but it may.

    Err, as House of Fraser aren't the manufacturer of the genuine Ralph Lauren items how can they be used as the definitive proof that the item is fake. Surely that can only come from the design licence holder which in this case would be Ralph Lauren. http://www.ralphlauren.co.uk

    Obviously that's true but their staff are usually quite knowledgeable. Oddly enough a few years ago I was asked to sell a large amount of a branded perfume and was unsure of it. I checked it with the same brand perfume counter at House of Fraser and they found it to be a fake from one tiny detail that most people would miss.

    Not True, the OP purchased conterfeit goods and then resold conterfeit goods

    1 or 1000 it is still a counterfeit item and the OP can be charged

    Idiot does the above - me - i just get my money back and move on with my life. Buyer was a private seller. I bet the buyer calls the police when their neighbour has too little air in his tryes.

    Also, as stated - it wasn't even taken to the right place to check it. How do we know the store arn't just peeved at people getting cheap stuff off ebay and arn't just saying they are fake?
