It could be argued under the Sale of Goods and Services Act that the router formed part of the initial contract, thus the supplier are liable for it for the duration of the initial contract. (Unless they have a T&C that expressly states that the router is excluded and is the customer's responsibility from the outset).
Hence the final paragraph of my first post.

It could be argued, yes. But they're still not responsible for installing it or maintaining it, so the attendance of a Qube/Brightsparks rep (I won't grace them with the word 'engineer') would always be chargeable. Their liability would be limited to supplying a replacement.
If you are offered say a replacement TV under SOGA, the retailer won't come round and install it for you-or they're not obliged to.No free lunch, and no free laptop

the engineer found TWO faults: 1)a broadband connection that was not always on.2) a fluctuation in the speed & therefore stability of the connection .
He summised,but could not say DEFINITELY the latter was because of the modem & left a new one with me saying to give it a few days (because he had tweaked some settings that should be allowed to 'settle' & that if the problem persisted they would 'up it' to BT.
So I've pitched that at them.
Having read TT's t & c's it seems TT say modem is sort of their responsibility up to 18 mths after which it becomes customers property/liability. This could be grounds for a consumer law issue but I'll go on the first 2.
If an always on connection isn't always on and the connection i unstable surely he identified 2 faults.

I just checked my new talktalk email account (i8talktalk@talktalk.net) and they've refunded me £50 ::beer: 3months left on contract and they've had it
