    How is the rest of the boundary marked, is it clear what identifies the red line?

    I wouldnt get into an argument about it but i would check the wood is only above the damp course and not above and below as that would let (a small amount) of damp get above the wood, but probably not going to cause any problems.

    A little bit cheeky maybe, but unlikely to give you any problems.

    I think there's possibly the chance that gate was installed with entirely good intentions and it maybe didn't actually occur to the tenant that they were violating a boundary.

    From what I can perceive the main issue of contention from the OP point if view is the lack of prior discussion and hence permission. This has been taken as rudeness.

    But instead of responding with rudeness it may be a better idea to at least to try to friendly point out the whilst it may have been unintentional it was a trespass upon your property and in future if they could talk to you first before installing anything along the boundary.

    Had they asked first, you may well have agreed to it anyway.

    I can see why you are annoyed about it.
    Our neighbour was always cutting the privet hedge between us right down and then moaning about the kids' footballs coming over. she then started to trim it back so far that it was completely on our land so we decided enough was enough and built a concrete fence, the fact that she hates concrete or corncrete as she calls it was a complete coincidence.
    A couple of weeks later I could hear drilling so went out and looked over the fence only to find her son in law drilling into one of the posts to put her a new gate up.
    The fence is all on our land, in fact it's given her an extra couple of inches but I couldnt get it through to him that he was trespassing and had no right to touch our fence so had to get my son on the phone to stop him.
    I know he lives in a rented house so maybe that's the problem, they just dont understand that our property belongs to us not some nameless landlord.

    It will be interesting to see what happens if your proposed actions effectively block their attempts to keep the puppy controlled.

    We already know they are not too bright or thoughtful, so you should be prepared for a fairly unmeasured response.

    Well yes, it will be interesting, but ultimately it was her decision to get the dog and as such she will have to work with it to come up with another solution. I may just be being pinickity but I brought a detached house for a reason, I don't want someone thinking they can just affix things to our wall as they see fit and then us have to suffer with possible gate noise etc.

    With the greatest will in the world, I don't want to have a bad relationship with our neighbours but I don't really see this going any other way :(

    Am about to ring letting agency to let them know of what has happened, and then will drop in tonight when I get home to let her know that we want the post removing from our wall.

    I don't think that has anything to do with it at all. You get unthoughtful people that are homeowners, and you get some who are tenants. Most boundry disputes are homeowner to homeowner anyway.

    Neither actually. My post was intended to lay out the rights involved.

    How the OP chooses to proceed is an entirely different matter, but it is always helpful to know the legal position (and in this case the damp proof course risk).

  • Personally - I don't think the game would be worth the candle (ie of saying anything to your neighbour about this gate).

    Strictly, they should have said what they were planning to do - but it doesnt sound as if it has done any harm to your property at all and a back gate is, after all, a necessity. If their alteration had been for "cosmetic" purposes that would be one thing - but since a gate is a necessity then just leave it.

    After all - one thing that would be a certainty if you say anything about a small matter like this is that they won't consider you at all in future in regard to anything else (no watering plants/taking in parcels/being helpful to any of your visitors that have come to the wrong house by mistake/etc).

    All round, it's just not worth the aggro for such a little thing as this.

    Ok, I've posted my views on the other thread, but to be honest if they had asked I would not have allowed it.
    Now what's worse is the fact that the gate is hinged onto your wall meaning that every-time the door clangs open it will resound through your house as it swings back against your wall, that's creating a nuisance.

    Our neighbours moved a few months ago, (thank gord), the new lot asked the neighbour above if they could do just what your neighbour has done. Even though they wanted to attach to his garden retaining wall rather than to his house, he refused.

    Make of that what you will, I'm still unsure if he was morally correct even if legally he couls diss-allow them.

    Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)
