yes he will - and his current visa might not allow him to get married in the UK without first returning to his own country of nationality to change his visa status.
Even so, registrars aren't daft and will look very, very closely at someone who after living in the UK for 9 years on a student visa applies to get married just a few weeks before the visa runs out.
.................:)....I'm smiling because I have no idea what's going on ...:)
  • My opinion (based upon the limited facts I have available to me) is that he wants her to stay in the country at the very least. He is clearly being very open about that.

He has been encouraging her to make home improvements (out of her own pocket) which seems a bit fishy.

The sad fact is that she can't see it and has pretty much said, so what? If it is a mistake it is a mistake. I just can't bear to stand back and wait for the inevitable train wreck.

The danger is OP, that if you judge her relationship so harshly to her face, and offer her no support, she'll just ignore every piece of advice you give her because its not what she wants to hear.

I'd try this from a different angle. He seems a bit confused about his visa status, so I'd suggest to his girlfriend that she gets involved in sorting that out so that everything is legal and above board. If she sees the visas he's had, the one which is due to expire etc, she can use the UK visas website to get the current law on where he goes from here, to be able to stay legally in this country. Marrying her does NOT automatically give him right to remain in the UK, so best she gets as much information about this as possible.

Good advice above. I have an acquaintance who is also losing their visa in March after 8 years as a student at a certain london University that lost it's right to sponsor students last year. Could your friends partner be at the same uni?

She (my acquaintance) is also contemplating an ill advised sudden marriage... dangerous path for people to travel I think, without the certainty of getting a visa anyway.

Re protecting property, it's hard to do that legally anyway. Pre-nups are not binding in the UK, but judges often take into account how long a marriage has been in splitting assets. It's not always a 50/50 split from day one.

Please read my post above. Pre-nups are much more recognised and valid in UK than they used to be. The courts still retain an over-arching power to adjust property shares on divorce, but in the absence of significant change of circumstances, will not normally seek to undo a pre-nup.
I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
  • time2deal, It is entirely possible that they go to the same establishment.

I will pass on the advice, hopefully I will get it reiterated and reinforced via another long standing friend who is in closer contact.

after everything that is always in the newspapers, magazines etc., why do people still insist on doing this??? are they really that blind???? he will certainly take her for everything he can, and i bet he hasnt been travelling to study either. poor woman.........
  • The incredible thing is that she has cast aspersions on another person who made not too dissimilar nuptials albeit with a holiday hunk.

You could not make it up.

OP I would call the immigration service immediately, I think maybe your friend may love this bloke, I think he may have other motives for wanting to get married.

He is obviously an over stayer and has got away with it for so long hopefully he will get deported back to africa so he cannot cause any more harm to your friend or anyone else.
  • She clearly does love him, so much so that even though he has said they need to marry so he can stay here - she is still game.

She is going to hate me forever if I do it....
