Flight delay and cancellation compensation, Virgin Atlantic ONLY

Wowsers, you guys need to chill out. Anyone would think you worked for Virgin. I have not asked anyone to do any work on my behalf, just simply asked for direction. Crikey, we dont all understand the law! And if i wanted this now now now then i would have put a claim in way back when martin lewis first mentioned it and not waited until now. But hey ho if having a pop makes you feel better then pop away.
I understand being nice takes effort :rotfl:0 -
Hi, was wondering if anyone else had claimed for the cancellation of flight vs0015 from gatwick to Orlando (due to leave on the 1st May 2008)?
There were 5 of us I sent a claim in for each of us (2 adults and 3 kids). We lost 1 whole day and night of our Disney package due to this. Flew from Edinburgh for a connecting flight (all booked through virgin), to be told when we got there the flight was cancelled. Didn't end up flying until the following day. Any way got the 'regret to tell you declined for the delay being caused by extraordinary circumstances'. Unforeseen technical issues, fix was too complex and didn't have the part as it was rare. Received that on 21st march.
So I have written to passenger complaints at Caa, got an e-mail acknowledging receipt, they are saying as they are so busy taking up to 8 weeks to reply. Still waiting. Those who want an indication of time here's my experience...
Sent claim forms to virgin 12/2/13
Got acknowledgement back 01/3/13
Got regret letter 21/3/13
Sent complaint to caa 29/3/13
Got e-mail acknowledgement from caa 9/4/13
Still waiting on a response
So if I could refer to anyone who has been successful for this flight or get an thoughts on if I should persue via court if caa can't enforce that would be fab. Also think watchdog are covering this topic on we'd 8th may so will be interesting to see that.

My wedding flight vs 79 was delayed in 2007 feb ,man to Saint Lucia , for five hours. I've just had the knock back letter stating its over six years ( by a few months) what now ? Am I best getting the reason it was delayed before taking action ? Why is uk six year rule in place? There's five of us.0

Too late I'm afraid - UK law restricts claims to 6 years from date of delay.0 -

Isn't it extraordinary that, when faced with the six year limit (which only relates to court action - it doesn't preclude the applicant claiming in the normal way), the airlines drop all pretence of 'extraordinary circumstances' and simply say: we won't pay and you can't make us. Telling, isn't it?0 -
Has anyone put in a compensation claim for the canscelled flight vs52 on 20 nov 2008 from Tobago to Gatwick. I have put a eu compensation form in to virgin and I have had a acknowledgement letter to say it may take 6-12 weeks for an answer. The delay was due to technical problem with flaps and they needed a part flown in from uk so there was 24 hours delay. I expect virgin will use the normal exceptional circumstances rubbish. If I have to go to small claims online I may be thick but how can I send all my paperwork to them as don't have a computer or scanner just an iPad does that mean I will have to do it paperwork way? Please advise:)0

As I've said before, going through with the court process is the only language that Virgin understand.0

I've done a complaint to the caa saying the exact point the guy said before. Why should that supposed six year rubbish stop a claim when it's legally ok back to 2005.
I'm not taking them to court I'm claiming through a process set up by the system.0 -

I hope I haven't given you false hope. Just to be clear, you haven't a chance of getting a dime. The CAA can't make the airline pay up, even if they rule in your favour.0 -
VS027 1 June 2012
DS and DH had the following delays-info from Virgin back in November 2012:
I can confirm that flight VS0027 from London Gatwick to Orlando was delayed on 01 June 2012 due to operational reasons.
The scheduled and actual arrival and departure times are shown below. All times stated are local times:
Scheduled time of departure: 11:15 – 01 June 2012
Actual time of departure: 14:36 – 01 June 2012
Scheduled time of arrival at Orlando: 15:25 – 01 June 2012
Actual time of arrival: 18:18 – 01 June 2012
Delayed arrival time 7 minutes under three hours. Does that mean straight off there is no claim here?“All you need is love. But a little chocolate now and then doesn't hurt.” Charles M Schulz0
