    If your flights and accommodation were all booked together as, in effect, one holiday, the Package holiday regulations may apply and you may have a claim against Virgin under them

    I think Delta would have a different opinion though...claim is from the operating airline, Delta will say they were not departing from the EU so does not apply
    Virgin will say they did not delay the OP

    If Virgin sold the ticket then Delta are in effect sub-contractors...

    Delta own 49% of Virgin btw.

    Nope. Delta are the operating air carrier.

    The airline industry codeshares, dry or wet leases, it doesn't 'sub-contract'.

  • Hello, first time posting. My family experienced a delay to our return flight to back to LHR having had a lovely 3 weeks doing disney and sunshine in Florida. We booked direct flights LHR-MCO outbound, and 1 stop flight MCO-JFK-LHR.
    Our return flight between MCO and JFK run by Delta on behalf of Virgin was significantly delayed leaving MCO and arriving at JFK to the point we missed our onward flight with Virgin to LHR. as a result we experienced a greater than 24 hr delay to return flight and resulted in an unchartered stop over in New York.
    We have contacted Delta and they have kindly offered $200 each ($800 total) as compensation.
    The main issue is that the compensation is a voucher in us Dollars for use on Delta or associated airlines, but seems only able to be used on America based flights, which seems odd considering we are British residents.
    Should we be granted compensation in the currency we paid (Stirling) and in hard cash?
    Should we be able to use the 'vouchers' in Europe should vouchers be maintained rather than cash?
    Considering the length of delay, should we be entitled to greater compensation having flown in and out of an EU airport, despite the initial flight between MCO and JFK (non EU)

    Any guidance would be appreciated.

    Just because they are in dollars doesn't mean you can't use them for a sterling fare. They'll just be calculated at the exchange rate on the day you book.
    No you won't get cash, it's a goodwill payment they don't have to give you anything.

    EU regulations don't apply as you weren't on an EU carrier and you weren't departing from an EU airport.

    Hi guys, my Virgin flight from LAS-LGW was over 24hrs late leaving Vegas at the weekend. Any anecdotal evidence of how difficult Virgin will be to get compo out of? I couldn't see a thread for virgin.....
