That's a great result - well done.

Can you give us a bit more background? What was the reason for the delay, how late were you, and did you have to start legal proceedings or did they just pay up?

It was 4 hours delay. Started with a delay of 2 hours and kept going up, staff said to us at the time it was for operational reasons, I put my claim in on Monarch forms at the beginning of December, I have not had to do anything since, other than a chasing email in January, you certainly could have knocked me over with a feather when I read the letter after following this thread ( rather obsessively ) for the last couple of months. Good luck to all waiting or pursuing Monarch!

MON7208 04.09.10 LGW- Dalaman delayed 11 hrs 50mins. Just had letter declining compensation for delay citing "brake accumulator fault" as EC. On arrival at airport at 6am, check in was not open and previous evening's flight to Dalaman was still waiting. We believe our plane was used to take previous travellers out and and bring others back, before taking us. Has anyone else claimed for this flight? Do I go to CAA now, asking for confirmation of whether or not this was in fact EC? any help appreciated. thanks

My claim was rejected (extraordinary circumstances) due to damage on a cargo bay door.
Given that the CAA are saying:

"Despite the word extraordinary, it does not necessarily mean it is a rare event, it just has to be outside of the airline’s control."

I am not confident enough in my claim to pursue it further in the small claims courts.

As a result, I think the best option for me (and this is by no means a suggestion to others), is to use a claim company to take my claim forward. I don't have the time to devote to a small claim of my own, so accept that a company may take 25% of my 'win'.

Where is the best place to look to find a suitable claim company?
The FAQ suggests trawling the forums to find 'success stories' and 'recommendations' - but that is easier said than done.

    Thanks.
    SC

EDIT: Scrap that. I am reading that Monarch are settling out of court for some people. Sod it - I'll do the mcol thing.
EDIT 2: My total claim is for 500 euros. There are fees to start the mcol.
I'm fancying 'claim companies' again. Still interested in a few suggestions so I can compare and weigh up the options. Thanks.

I've just had a rejected letter for Flight ZB743 Malaga to Gatwick - 14th July quoting "Cracked Windscreen" and extraordinary circumstances.
However, I clearly recall the pilot on the flight giving an in-depth explanation on how it was related to something to do with a steering issue on the front wheel.
I guess it could have been classified as nose landing gear as quoted in Mark2spark list above, but it definitely wasn't a cracked windscreen.
I guess it doesn't make a lot of difference as they classify both as extraordinary circumstances.

    Thoughts/comments anyone?

So you would rather get on a dangerous plane and have no delays? Delays for my safety are welcome, But if you want to squeeze the airline for compo then go for it, but remember when Martin "lets screw every company on the planet" Lewis is done, YOU will be paying for your compo. As they will pass the increased costs to YOU. Remember it could be YOUR job at risk next because of this compo culture.

Oh well, choke on your compo

Delays and safety are two separate issues. Monarch have delays for a number of reasons but the age, type and location of their fleet is their main problem. They experience delays and technical problems with their older planes (for example they have three Boeings over 25 years old) - that is not to say they are not safe as they are but as with an older car things go wrong more often and when things go wrong they have to be fixed hence they have delay periods way in excess say of Ryanair and EasyJet. If Monarch flew their planes on time there would be no compensation payable - the fact that 3% of their flights are delayed over 3 hours means they are obliged to pay - this has nothing to do with safety and pax should not be worried regarding this aspect.

If you look at airlines' published accounts, see the links on their websites, you'd notice that EC261/2004 'compo costs' are negligible, and your 'not nice to money savers' comment would be nonsense.
