Thanks very much. After seeing the reasons for this delay on the original post I've just spent aeons trawling through from page 1 _pale__pale__pale_ so I could liaise with you about it but unfortunately it doesn't seem to be the same flight.

Ours was ZB532 Man to PMI on 09.04.2011

Mark2Mark - can you amend the OP list please. Monarch's reason to me for the delay was rudder defect

Ok Sue I've added yours. But I'm really confused now, as there clearly is another flight, same flight number, same date, same destinations, listed as a different reason, the reasons that Doris touches on, in the OP.
There is a third post, same destinations, with the same reasons as Doris mentions, but different dates.
I've highlighted the three conflicting posts in blue for now.
I'm in the process of editing all the other flights denied so it might be some time before it shows up in blue.
I might have to check the overly long original thread to try and find this rogue post with a different reason. :undecided

So that makes 3 merged flights in 7 days on the new UK - Italy routes introduced by Monarch in summer 2012. Monarch seem to be have been very lucky in having "technical issues" conveniently associated with these flights which allowed them to operate 3 planes instead of 6!

It's taken me ages but i've pieced together these merged flights now, and have updated the OP with these flights in orange, with the post numbers, so that you can see the 4 different reasons so far for these delays, - all extraordinary circumstances! :rotfl:

I see the other (preceding or following) flight has been logged for this by Mark already. A bit like my flight from Sharm, which was caused by a crack in the preceding flight.

Not very extraordinary. As we all keep saying.

It would appear that it's the same cracked screen being cited as a knock on effect for all of these flights.

All cracked screen flights now highlighted in purple if people want to try and piece things together.

It's a tech issue and unless the manufacturer has recalled all of that plane type for rudder inspections it's not EC.

They gave me the same reason for my flight ZB661 from Malaga to Manchester on 8th July 2012. What was the date of your flight?

OP now updated to include this with post number

Although a selection of county court judgments on 261/2004 cases would be worth having, and considered persuasive in other county courts, those courts would require an official transcript of the cases cited in order to consider them, and unfortunately that's an expense that most successful litigants wouldn't bother with, having won.

I mean if we can start to see a succession of successful court claims, where a judge throws out Monarch's EC claims, then others will be bolstered by this news.

The only thing that I find a contradiction in the wording of the ruling/regulation is the bit that goes '...on a particular aircraft on a particular day'.
Which, to me, could be read that knock on effects on a short haul programmed/scheduled aircraft might have a loophole if the original cause is determined to be a valid EC.
After 24 hours the EC claim becoming invalid I mean.

But I'm really confused now, as there clearly is another flight, same flight number, same date, same destinations.......I know the feeling Mark, in the OP the flight after yours is same number as mine, different date, been paid!!!! but have tried to contact them but no joy, so I don't know what the reason is... am guessing the original excuse was TF....

Any ideas on how I could find it out? as mine seems the only Fuel Valve listed lol, would be good if there was another :)

The rumour that Monarch airlines would reply to all claims by the end of February is clearly not true. I am still waiting for my response for a claim that commenced in early November.I am sure I am not the only one!!!
