Monarch Airlines aims as its first priority to provide its passengers with a safe and efficient service. We would like to reassure you that every reasonable effort is made to ensure that our flights depart on time and in the unlikely event we are unable to do so through disruption, we aim to provide a solution at the earliest opportunity.
As previously advised, in some circumstances passengers may be entitled to compensation for delay arising from such disruption under European Union laws. However, any monetary payments are subject to certain criteria being satisfied. Under these laws where the disruption is caused by an ‘extraordinary circumstance’ which the airline was reasonably unable to prevent, the carrier is not obliged to pay compensation. Extraordinary circumstances have been defined by the courts and the European Regulations themselves provide a non-exhaustive list of which circumstances can indeed be categorised as extraordinary.
Our record show that the aircraft scheduled to operate your flight suffered a fault with a pipe on arrival in Palma that stopped the crew being able to start the engines. For safety reasons engineers declared the aircraft unserviceable until the fault could be fixed. Due to the nature of the problem, specialist engineers and parts were flown from the UK to Palma. Despite our best efforts we were unable to transfer passengers to an alternate aircraft from within our fleet Unfortunately these events led to a delay of the scheduled departure time of your flight.
Having considered the factual background of this case, we are satisfied that the disruption was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given.0 -
Evalina - typical Monarch response - remember a technical problem is commonplace not extraordinary however experience indicates you (or a no win no fee firm) will have to convince a judge this is the case as Monarch will continue to deny your legitimate compensation is due.0

My daughter was under two when we travelled but there is an infant charge of £35 on the holiday invoice. Would she be included in the claim?0

I have been searching, and looked at Article 3.2. I know that those who travel free are not included but cannot find anything further.
Have now found further information. Monarch have sent compensation cheques but not included my daughter. I have emailed them so will wait and see.0 -
I have written to the caa and they have sent the complaint back to monarch to reassess the claim, if no joy there how do I go about taking them to court?

Court looks a good place to be. We have just received, and cleared, our cheque in full payment for compensation for a delay caused by crew sickness in the flight before ours. Looks as though there was an epidemic at the time of your journey! Perhaps you should be grateful you were not exposed to all their germs. :rotfl:
Monarch had initially refused our claim so I went the MCOL route. They said they would defend, did nothing, I requested judgement and just over 3 weeks later, a cheque for the full amount landed on my door mat! Imagine my surprise!!

There is no way I could express my gratitude to all the wonderful people on this forum, without whom I would never have had the nerve to go forward. If you all knew what a shrinking violet I am in real life ... Hey, with the support of the likes of Mark2spark, His Holiness the Lord Vauban, 111KAB, Centipede100 and various others too numerous to mention, I could take on the world!
I would encourage everyone else to go the MCOL route, especially if they have an unshakeable case. I did it all from abroad! Now I can relax and look forward to our next holiday - obviously with a different airline. Oh, and wait for The Continuing Saga of Monarch Airlines to come out on DVD. It has all the makings of a best seller. You couldn't make it up, as someone has already stated. Thanks, guys. :T:j:T0 -
