I have written to the caa and they have sent the complaint back to monarch to reassess the claim, if no joy there how do I go about taking them to court?

WEll Monarch have developed a new tirck, they telephoned the court and claimed the debt had been paid and to cancel the warrant!!!
I know because the court phones me to clarify if that was the case.0 -
Hi im new to the forums so please let me know if I have posted in the wrong place.
We have just been refused compensation for a 13 and a half hour delay from Manchester to Zakynthos, does anyone else think that this fault should have been found during routine maintainance?

Our records show that the aircraft scheduled to operate your flight was discovered at Gatwick after operating its previous sector to be suffering with corrosion of the right hand outboard trailing edge flap lower surface which was outside of repairable limits and therefore a flap change was required. In light of the extensive rectification work involved our operations team, in order to minimise the disruption caused, arranged for an alternative aircraft from within the Monarch fleet to operate your flight albeit with the unavoidable delay you suffered. I can confirm that the issue which presented itself was not as a result of failing to maintain the aircraft and therefore was an unpredictable, unforeseen event.
Do you think it is worth pursuing? If so what are our next steps?
