Thanks for your kind replies, f.o.bill had seen your posts and considered going down the Data p route and thought it might be going to a level not required but may as well take belt and braces attitude.0

Just wondered if anyone had gone with EU Claims/BOTT & co.
Basically I rang them and thought the 27% commission along with £25 admin fee per person was quite fair.
On further looking into their fine print T&C's they ask:
If you have home insurance that covers legal
That if you go with them you waiver your right to any interest
If you do loose you will have to pay the opponents charges & disbursment and also BOTTS disbursements.
Now this was originally sold to me as a No Win No Fee but now I'm thinking eek!
My sums may be wrong so please be easy on me but my claim is for 4 passengers x 600 euros from June 2011, therefore I have calculated at approx.
£2000 comp (4 x 600 euros)
£160 interest
BUT BOTT will take?????
£583 (27% of claim)
£160 interest
£125 (4 x admin fee)........ totalling £868
By my way of thinking is 40% I would be paying to them..........
Am I right.......... and also why would I have to pay disbursements and possibly use my home insurance?
thanks

Well it ain't no charity, that's for sure!
Not sure why you would use them, on the basis of these T&Cs. It's a hefty price to pay - without any guarantee that if you lose you don't pay. Most odd ...0 -
Hi Vauban, I've PM'd you in the past and the feedback from the 'A TEAM' on here is that I have a cast iron case but........... I'm WIMPY
Like I said, 1st lot of issuing docs they sent me and info on the phone was great but I don't see why I should have to use my own home insurance and default on MY interest.............. will give them a ring tomorrow if open and keep you all posted.0 -
All pretty standard stuff, but just to update the thread on a letter I received from the court on Friday :
"Notice of Transfer of Proceedings
In the Northampton County Court (because I started my claim on MCOL, all cases are initially allocated to Northampton)
Claim number 1AB23456
Date 2 July 2013
(my name) 1st Claimant (my reference)
MONARCH AIRLINES LIMITED 1st Defendant Ref CONTACT : XXXXXX XXXXXX
To all parties
This claim has been transferred to the below County Court for allocation. On receipt, the file will be referred to a procedural judge who will allocate the claim to track and give case management directions. Details of the judge's directions will be sent to you in a notice of allocation.
If you would like any further information you can contact the local Court directly but please await the Judge's directions
Contact details:
(address and contact details of MY local court - this is as expected. Because this case is Individual v Company it is allocated to the individual's local court.)"
So now I'm waiting to hear from the judge. I'll keep you all updated as I progress.0 -

Thank you for that, friendofbillw2. It is good to hear that some people are straightforward ie the courts.0 -

Just go off the phone to Bott and Co solicitors and they have agreed to waiver the interest (if case is won/any interest granted) :T
In relation to possible fee's to cover disbursements etc, then they will take out a insurance to cover if case goes to higher court or is lost. They reassured that there will be NO cost to me0 -

No problem with Bott & Co however easy to do yourself0 -

Intruiged as to how home insurance could be used. I suspect they have time limits for claims anyway. I wouldn't know who my insurance was with two years ago - never mind prior to that!0
