    Lovely reply from monarch. It now seems that ECs apply as long as one aircraft in their entire fleet has a problem. Here is the relevant paragraph claiming ECs.
    Our records show that due to a wing panel replacement rendeing an aircraft within the feet unserviceable and unsafe to fly, there were insuficient aircraft within the feet to operate your flight on time in spite of exploring all conceivable options, there was no immediate availability within our own feet to transfer your fight to another Monarch aircraft, or indeed to transfer passengers to an aircraft chartered from a third party operator. As a consequence the fight departed as soon as an aircraft became available.
    Before I re-read it I was going to give them another chance to offer payment, but this is such a weak response. The previous reply I got from them at the time, said that they had a technical fault on the previous flight, and when they arranged a replacement, the crew ran out of hours.

    Next step to serve them NBA, Will be claiming for interest since Oct 2010, when they originally denied compensation was due.

    I honestly don't know how they can keep a straight when writing letters like these. Having insufficient aircraft in their fleet seems to be less an extraordinary circumstance and more an unfortunate habit. I cannot believe any court would give Monarch the time of day with an argument like this.

    I can't see this flight referenced anywhere, apologies if I have missed it. Any other passengers from this flight here? We were delayed 25 hours following a technical problem which couldn't be fixed before the crew went out of hours.

    Monarch have just declined my claim with what looks like the standard response I have seen elsewhere on this thread. I plan to reply before moving onto small claims (although will check with my home insurer first to see if covered by my legal protection policy).

    Would be good to know if anyone else is planning the same as a result of this flight delay.

    We almost had a match - over 24 hours delay on ZB249, but 8th April 2012, rather than 6th April 2013! Otherwise it sounds very familiar ...

    That's extraordinary. So 24 hours after we got back the same problem - what was the cause and how did they treat you? Planning to pursue them?

    I've just searched through the whole thread and realised that Monarch has sent rejection letters to many people blaming problems with "left rudder", but never with "right rudder"!

    (Yes, I know there's only one rudder. When pilots and engineers say "left rudder" they are usually talking about the leftward deflection of the rudder, or the left rudder pedal, or the linkage between the left pedal and the rudder.)

    Could this be pure coincidence? Could this be a psychological trick, helping to put people off due to the connection of the word "left" with "sinister"? Could it be that left sounds more convincing than right, since right is not wrong?

    Not quite. We were almost exactly a year before you! I am taking them to court. Now just waiting for a date.

    Background is in #1180 on page 59.

    It tooks months for Monarch to respond to me - in fact they didn't, or at least not until I started legal action. I'm now just waiting for a court date, Avignon submitted my allocation questionnaire at the end of March. The process is not swift!
