    Any idea what the theoretical airline's claimable expenses could be? Or should that be 'airline's theoretical claimable expenses'?

    But from what I've read in the notes for claimants, it's not always either a win or a loss - the court can award just part of a claim.

    So are you saying I should not even reply to their email to say I'm rejecting it and my NBA still stands?
  • for information I've received a rejection letter from Monarch today for a 20 hour delay on the above flight. Our friends have also received one. Is the next step to complain to the CAA? Or straight to small claims court? Also can the above flight be added to the list of rejections. Thanks

    I'm about to submit a claim letter to Monarch for a 7hr 30min delay from Manchester to Menorca last year.
    There were 6 people (inc. 1 infant and 1 3yo)

    The delay was due to a technical fault with the plane (we were told at the time a fuel leak).

    I have an email from Monarch apologising for the delay, stating that it was their fault and also a list of the timings (scheduled departure, actual departure etc etc).

    Going by the claim procedure on MSE we are technically entitled to a €2400 claim (total).
    However, the flight only cost £1100 at the time.

    My question is whether i should put the claim in for the €2400 or put it in for less?
    Is it more likely to be accepted etc?

    Any advice appreciated.
  • How many flights can monarch claim Knock on (EC) from the origanal fight delayed by a fault. Surely more than one knock on would be classed as unreasonable to deny a claim as (EC) on the second or in my case the third flight affected by the Knock on with no other reason for the delay

    1) Without any admissions as to liability or to the merits of this case, the Defendant does not wish to dispute this claim and shall make full payment for the whole amount claimed.

    I'd like to say two things:

    First, this implies that Monarch ARE admitting that an engine failure is NOT an exceptional circumstance, despite their repeated pre-court denials (yes, yes, I know their submission says "without admissions as to the merits of this case").     Congratulations urban! Hopefully this points to Monarch finally beginning to take a more pragmatic approach to legitimate claims. The best they can hope for in denying those is that some people will get tired along the way and give up.

    The way forward is clear. Go the distance!
