    Yes, if it's submitted with the ESA50. Typically claimants end up at tribunal because new evidence is introduced at that stage, rather than assessment stage, often substantial enough to be considered a almost a new claim.

    ETA - ATOS Rep had it covered from their pov too.

    The problem is that the so called Atos "healthcare professional" should at the Filework Stage request FME. However because of targets this rarely happens, Atos aren't there to pass any claimant they're there to fail you. This lack of following procedure leads to genuine sick and disabled people being denied ESA (the whole point of Atos) then if they have the strength to carry on with an appeal (or haven't died!!) they then submit the FME (which Atos should have requested in the first place) which when examined by the medical expert on the appeals panel overturns the sub-standard WCA previously carried out by Atos within minutes!

    During my last WCA in may last year my partner who speaks alot for me due my issues with both articulation and anxiety was asked tobe quiet and let me answer. Is that right?

    During the MPs debate about the inhumane treatment handed out by Atos towards sick and disabled people this disgraceful practice was highlighted.
