  • Will try to send copy of some of Popla Refusal of Appeal - it was quite lengthy. I am a bit concerned about whether ParkingEye might take me to small claims court for 'breach of contract' on the strength of the Popla refusal. I am not familiar with legal matters so have not a clue as to what is involved or what I might be letting myself in for. I am in contact with an Ombudsman but don't know if they can help or not. Fed up with the whole business!

    You should simply ignore the ruling, which is not binding on you at all, and not at all surprising since POPLA is wholly subservient to the BPA.

    If the PPC does take you to court, it will lose, especially as the parking was fully paid for, no loss was caused, and you certainly did not enter into a valid contract to pay a punitive amount.

    In short, ignore everything except stamped court papers. If you get stamped court papers, post on here and on Pepipoo for advice.

    the odds are they will if you do not pay (The BPA are insisting members should take motorists to court if they win at POPLA and the motorist fails to pay), post on here or Pepipoo that way you will get help and in the long term..help others, plus you will get a great defense that will win in front of a real system and not a puppet system.

    I disagree with Dave.

    I do not think PE will bother taking you to court.

    Its easy to post up the popla refusal. All I did was copy and paste the entire document, edit out your name etc.

    PE won't be able to sue you as they don't own the land and the ldna have got rid of PE

    Can you confirm you recieved a second letter from popla telling you to pay? Just copy and paste it.
    For everthing else there's mastercard.
    For clampers there's Barclaycard.
  • Cannot copy and paste Popla refusal of appeal for some reason into this post. The gist of it is that Popla think ParkingEye is in the right because even though they are not accusing me of being dishonest they still want £100 off me - they are accusing me of 'breach of contract'. If they think I am honest they must want the extra money because a mistake was made. Is this sufficient grounds for them taking action? Popla say the ParkingEye sign was very clear but I disagree. It said 'Pay & Display' so surely an inspector should have checked that people were displaying their tickets! I cannot prove that I paid but neither can ParkingEye prove that I have not. They have photos of my car arriving and leaving but none of the windscreen with the ticket on it.

    Can anyone give advice on copying and pasting into this forum?

    Try ctrl c to copy the text , then ctrl v to paste into a post, you'll find the ctrl button your bottom left hand corner of your keyboard, sometimes it's called control
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    It's the other way around - Ctrl c to copy, Ctrl v to paste.
