    TBH, I didn't think of keeping hold of it so don't have it any more. I guess I just expected that the seller would be reasonable and apologise and at least refund the extra postage.

    So is express delivery always pointless to you because if you pay for it but don't get it you still shouldn't complain?

    Hmm - I've thought of a business oportunity. Charge for express del. ; send standard and when people complain I'll refer them to "Sharpy's Law" whereby they are classed a moaning minnys.

    The item was axle stands which I needed urgently to fix my car as I am a carer for my disabled wife and the the car is vital (live out in the sticks). I paid a premium for a 24 hour delivery service. This was not provided (took 9 days). As a result I had no option but to to fix my car with it dangerously held up just on jacks.

    The items arrived to late to be of use. They were £22. The seller could not even be bothered to apologise. Whether it was their couriers fault or not, my contract was with them. they failed to deliver and should reimburse the premium I paid.

    The only thing they hve offered is that I return (at my expense) for a refund minus a restocking fee (I'm guessing that will be something like 20%). So I will end up with no item and be about £10 down.

    I may as well therefore keep them as I may need them again in the future, but I still believe I should have the postage premium refunded.

  • AFAIK "restocking" fees are not allowed under DSR. You could remind the seller of that. The items will always be useful and if it were me I would keep them but knock the seller on their stars, like one star for everything.

    ND does not usually include Saturdays, with any carrier. Even SD carries a further surcharge for Saturday delivery.

    The time scale is not acceptable, but you do not know who is at fault without viewing the full tracking, which you cannot do now.

    If the seller wont reimburse you, there is nothing you can do regarding the postage refund.

    If you wish to return the item, do it via a dispute. You must bear the tracked cost to return it, but you will receive back your full original payment.

    Most of the stuff I ordered throughout December was delayed in transit, including a handful of supposedly Guaranteed Next Day Delivery items from Amazon. I had a wine order which I placed a week before Christmas for next day delivery and ended up cancelling when it still hadn't shown up on New Years Eve. Point is, it's quite possible that the item was shipped as the seller says but that delivery was delayed.

    They have referred me to their terms and conditions, which only says that they do not count weekends for next day delivery (despite the fact that their courier Yodel does!) This would still mean that the service I paid for meant the item should have arrived on Monday 31st, not 4/5 days after that.

    Is there any way I can dispute through paypal or ebay that the paid for service was not supplied?

    Accept the fact you've received your parcel after the millions that was sent over christmas - accept the fact that you can not obtain your money back for the poor service they provided -

    And also accept the fact that the seller did infact send out on the 28th of December - yet due to Christmas Post and non working days and New Year etc - you received it some 9 days later - not as paid for in the first place for next day -

    Next day delivery over Christmas is next to not impossible - the only company to whom guarentee next day delivery over xmas period is royal mail.

    I also advise you leave them bad feedback and never deal with them again -

    Ask them for a partial refund for this first before leaving negative feedback.

    If your really that bothered about the additional £4.00 open a case as item not as described" - ask the seller to refund the £4.00 as a resolution"

    If seller refuses leave the negative feedback and dont deal with them again and also face facts your never getting your £4.00 back.

    Coincidentally, I needed axle stands at the last minute before Christmas. Got them from Screwfix for that same price. They are sold in loads of places.
