PCN Link Parking LTD for parking in our private residential car park

Hello all,
well what a shock I had this evening.
Firstly I’ll have to do some explaining... I live in an apartment block with private parking, most flats have their own allocated parking and then there are some visitors spaces. I’ve lived here for a few years now and got my car in March 2012. My parking space is in an underground car park and the concierge wanted 40 quid off me for a fob to open the gates, tried to argue it as we are only here for another year or so and it’s nonrefundable! He then issued me with a visitor permit, no problem, i can park here job done. So this is how i’ve been parking, in a vistor space, with my permit everyday since march 2012.
My car had been in the same visitors space since friday, got in it tonight and noticed that ominous yellow plastic peeping out from my wiper. Opened it up... 75 quid fine. I thought ah they haven’t seen my permit... except it wasn’t stuck on the window but on the floor. My car is old and gets condensation inside a lot... so i can only guess the damn thing just fell off in the last two days and obviously having not got in it to drive, i had no idea.
I’ve been reading around the internet and on here.... but just wanted opinions. There’s clear signage about the place, but i do have a permit and i am a resident so i wasn’t trespassing. I sent them an email with photos of my permit and a close up of my insurance doc showing my reg and address to confirm I live here (ok so now they know where i live... i really couldn’t care less tbh).
I assume these parking companies are hired to stop non-residents using up the spaces... so being a resident here, surely we are all exempt, especially when i have a damn permit... just worried they are going to argue why I am not using my allocated space or does having a vistors permit make it irrelevant?
I’ve requested the invoice be cancelled and for a response within 14 days. i’m not handing over a penny, i pay enough to live here without forking out 75 quid to park my car!

They don't appear to be in the BPA AOS list. So they have no way to get your details from the dvla, so just ignore them. This fake PCN would have been the only thing you'd have heard about it but if you've given them an email or other details you'll get threatograms. Didn't I review this contract in another thread? Well, I skim read it and found a dozen or so reasons why you'd need to have a frontal lobotomy before signing it.
I'm dumbfounded that people (I assume) do actually sign these things - they deserve all the crap they get.
To the OP - Ignore it all, no loss to landowner equals no liability for any charge. The whole thing is a big bluff designed to scare you into paying. No court action will ensue, no bailiffs will come and get your telly, no CCJs, no damaged credit rating, its all crap.Je Suis Cecil.0 -
i’ll just ignore anything i get from them, i did send them proof that i was a resident i.e. my address but we’re moving soon so i don’t really care lol.
Inever even seen that contract before until just now but it seems aimed towards those who employ them not residents...
i did read the post about the contract... the whole ‘client’ definition followed by ‘the client must display a valid permit’... did make me chuckle lol
Has anyone ever had one of these companies go as far as court action and what not?? just interested to know if any of them bother if there is little gain on their part...0 -
They won't do court, but make sure you forward your mail onto your new address, just in case they get a letter returned by the next residents as unknown at this address. It has been known for parking companies to try and get a default judgement.
Its a shame you contacted them though as they had no means to get your address except from you. And the contract is for the people who are stupid enough to engage them. the only way they can get my address is in a photo i attached showing my reg no and address on the same document... i didn’t write it in the e-mail and guessing by the numptys they employ i’ll be interested to see if they have the common sense to use the photo to gain my address and thus send me some letters lol0
