You don't have to return it within 7 working days - just notify them in durable form. Often email.
It seems you notified them by letter when you sent the goods back, dated the 4th although it may be considered served on the 5th.... even taking the date received as being the 21st you've missed the 7 working days.... so hopefully they will play nicely.
The only way I see you being able to fight it is if you claimed you received the goods a day or so later. Or if i've worked out the 7 working days wrong as there has been several bank holidays recently0 -
Just sending the item back is not good enough,
Eh not entirely true. Would be quite easy to argue that sending the goods back would be a durable form expressing your intent (that you no longer want the goods) and DSRs allow for cancellation "however expressed".It seems you notified them by letter when you sent the goods back, dated the 4th although it may be considered served on the 5th.... /QUOTE]
Its taken from the date its sent/posted.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
The right to a refund isn't determined when you send the item back, it's dependent on when you inform the seller of your intention to cancel. In fact sending the item back is not a condition to your rights to cancel and receive a refund. No they dont have to refund you, you returned the item too late for a refund0 -
Thanks everyone - I have the information I was after and the links to (DSR) prove it.
I'm actually the seller ;-)

Why not just tell us your the seller in the first place? Despite it being a consumer rights board we don't dislike retailers and often defend them if they have done nothing wrong

A pain in the backside but why not just refund anyway (technically I think they are over the limit by a day but your courier hasn't helped), if you sold somewhere they can leave feedback then it will pay to just refund them.0

ZOMG! Bruce Willis was a ghost! One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0

Well, as the seller, did you give your customer written advice of their rights to return the goods under the DSR's? and if so, did this written advice clearly state that they had 7 working days following the day of delivery to advise you of their wish to cancel the contract?
If the answer to either part is no, then you customer has up to 3 months and 7 days in which to cancel and you must refund them in full (and not by way of a credit note) within 30 days of them contacting you with regards to wanting to return the goods.0
