I received back all my data protection information last week, in the form of copy statements (about 40 of them!) which they charge people about £5 each! I have calculated what they owe me and added interest so total requested is £583.00 plus interest of £140.50 (using MSE calculator) which I sent off straight away giving them 14 days to reply. I ALSO stated that this was a complaint (many thanks manfromthepru !!) as they did not supply information within the 40 days and I said if they did not reply within the 14 days I would go the FSA. I have received a reply stating they are investigating my complaint and will get back to me as soon as possible. Looks like its made them deal with my case a lot quicker than normal, will post more when I get a reply. Oh, I also sent itm recorded delivery just to make it more official and it only cost £1.00.
Thanks again to everyone who posts here and I hope people who read the posts here will go get their hard earned cash back from the fat cats!!0 -

Well don't tell me tell michael, it was his point. I was stating something that has said by and on behalf of the (relatively) poor following last week's budget. You can't just state something or dismiss it without backing it up.The banks have made a fortune over recent years and some of that has come from penalty charges which have been applied to people's accounts for whatever reason. These may, or may not, prove to be unlawful.
They are unlwful aren't they? Pretty sure that's stated quite emphatically around these boards. Do you mean illegal? Which is, apparently a different thing and is open to some debate..The problem for the banks is that they want to improve profits every year and so need to find replacement income.
They're private profit-making businesses, it's not a problem. I work for a profit-making business, you quite possibly do too. We have targets, if we meet them we get rewarded, if we don't we get shot.They've been trying to remove free banking for years....
They're not compelled by any law to provide free banking, or anything else. Don't you understand that??0 -

Tozer... we won't forget our credit rating - we won't forget our bank balances either. Or our snowballing debt due to charges. Or the £30 to send a letter. Or the £100 charges for an unpaid direct debit due to being overdrawn bacuse of bank charges etc... etc... etc...

Hi - glad you asked. I am a commercial lawyer that can see both sides to the coin. Yes, you are recovering charges where legally wrong - and good for you. Bad for you that you could not abide by the terms and conditions. Please do try and see both sides.
Oh, and by the way, the advice currently being given to banks is to defend and use the credit history as a means of "dealing" with these claims.0 -
What's using peoples credit history got to do with these claims??
Bottom line is bank charges are not proportionate to there costs...
Appreciate the advice, but are you saying if someone is sub-prime the banks will defend on that basis??

this is not the arguement, if you dont like the charges why open the account , the fees are laid down in black and white as you open the account
When you have no choice but to have your salary paid by bacs, you have no choice but to open the account. Every bank has charges!!!
Your thread has outraged me!!! My H was paid off from his job with no notice. He was given his final pay cheque and week arrears. Cheque paid into account for over £1k. The day after the cheque cleared I paid all my bills for that month, by switch etc. Two days later the cheque bounced. We were Landed with over £400 of charges for that week and no income.
Bank clerks told us cheque had cleared and would not return, they would not accept liability for giving wrong information and would not give us any financial help cos we had just recieved charges on the account. The following week my maternity payment was paid into that account for £400 and we were over £1k overdrawn and had to get into debt to feed our 3 kids.
You may not be rich, just good at handling your money, but anyone can be caught out like we did and the charges start spiralling. Don't be to smug!!!!!0 -

What? Did the check clear or did it bounce? It can't do both. This issue, whatever it is is more to do with the (ex)employer than the bank isn't it?
Sorry I'm not a spokesperson for the bank, I'm also not trademark in case anyone's wondering but there are so may confused-sounding posts on here it's not surprising people get themselves in a mess0 -

Nah mate. Just showed a deposit, I thought everyone knew that didnt mean it was cleared and you can view actual cash avaliable at any time at cash machines, online or via telephone banking.
Say I have a balance of 1k, put a cheque in for 2k from another bank.
Will show 3k in the statement, but avaliable balance will be 1k. They have to show the deposit otherwise we'd all wonder whether it got through.
This is the whole problem, people just not knowing or educating themselves about the system, again, its common knowledge and again, all in the T&C's.0
