No it just means that they are using the OFT deeming £12 as a more reasonable figure than they charged before as some kind of law, which it isnt. You can claim so go for it and good luck0

In my opinion, banks should totally abolish the ability of someone to "overdraw" on an account ..... period. Then those in "financial difficulty" could have no reason to pay charges at all. They can then resort to smashing up telephone boxes and apply for a refund to the magistrate after they are caught and fined which amounts to the same thing. Too many people spend money they dont have with no intention of ever paying it back, or with some fanciful notion that someday they will win the lottery or whatever.
The flipside is why should someone pay a high unlawful, I repeat unlawful, charge for going overdrawn so you can earn a lot of interest on your account ? Why should my money be literally stolen from my purse to go in your pocket ? It is the bank who fascillitates and distributes monies within its structure and your ire at people reclaiming and being helped to do so is misplaced. I might just as well rant at people who have high savings accounts for stealing my money, it just doesnt work the way you have presented and it is not our fault.
They could always charge a reasonable and lawful fee and give you all of that for your interest rate but then they wouldnt make a profit would they ? Bank charges only form part of their income allegedly so people reclaiming isnt likely to make that much of a dent in their income so any rises they blame on this is more hogwash that people such as yourself will fall for and get even more angry about.
Smashing up a telephone box is illegal, magistrates fines are lawful.
Going overdrawn is legal, bank charges are unlawful.
