Gas Fire Issue...

Basics of this story are:
Got a new wall mounted gas fire fitted in June. It worked with no problems, but because it was half decent weather, it was rarely used.
Come September when the weather started turning, fire was used a bit more often, but as time was going on, it was taking longer and longer to start, then it just packed up all together.
Contacted the makers as the shop we bought it from had shut down (old boy retired). Was told it would be a month before they could get an engineer to us. Complained to the technical director, had a technician the following week.
He changed all the insides. Fire still didn't work. Reccommended getting a cowl fitted to chimney, and was assured that it would work once that was fitted.
It didn't.
Maker now telling me that they need to get a special thermal coupler made, but they are not having a lot of joy from their R&D dept.
They are now bringing in a technician from another part of the country to try and fix it.
In the meantime, I have threatened legal action as the fire has been NFG since end of September and our leccy bill has gone up from £105 a quarter to over £700 because we have had to use leccy heaters.
Now I have said that if this guy cannot fix it next Friday, I want a full refund plus a goodwill gesture because of all the hassle caused by this.
Anyone know where I stand legally on this??
We paid cash for it, all legitimately and have the appropriate receipts.

You have no contract with the manufacturer so it might pay to play ball with them as they could turn around and say tough.
Your contract is with the retailer. It does sound though that they are trying to find a resolution.0 -

Retailer has closed down. Manufacturer is honouring warranty.They are trying to fix it what more do you expect them to do ?.

Wha size is the fire and what is it's efficiency?
£700-£105 divide by 91 days is £6.50 per day. A 2kW heater on maximum for 6 hours a day at a unit rate of 12p/kWh would cost £1.44 a day.:footie:
Regular savers earn 6% interest (HSBC, First Direct, M&S)
Loans cost 2.9% per year (Nationwide) = FREE money.

The manufacturer has no legal duty to honour the warranty as any contract you have was with the retailer.
I would be nice to them.
I'm at a loss as to what to do next. We've spent around £1800 on this supposed showpiece fireplace, but haven't had any real use out of it.
If they decide to back off, where do we go??Life is now good

Doesn't the manufacturer have a duty under warranty to ensure the product is fit for purpose?

You can't claim for 4 heaters when the output of that fire is quite small at 3.7kW. It's only 72% efficient so you would have used 5.6kW of gas to have an output of 3.7kW.
The maths don't add up. I know gas is cheaper but it's not THAT much cheaper. i.e one hour running that fire would use 5.7kWh to get 3.7kWh of heat into the room and at 4p/kWh would cost 22.8p/hour. 3.7kWh of electric heating at 12p/kWh would cost 44.4p/hour.
I really doubt you would have running on it's maximum setting for 24 hours a day as the room would be far too hot. My 2kW convector heater heats the room up to room temperature and cycles on and off to only use an average of 1kW every hour....for one room.
If you are going to take this further then be prepared for them defending your claim in court.:footie:

If I get a payment towards the electricity bill, all well and good. It will be accepted. If I don't, I'm honestly not too bothered.
I just want a working fire.
I'm just not sure how I stand with my consumer rights with this one.
The fire has packed up, and the manufacturer were really dragging their heels until I started mentioning legal action.
