benefits needed

I am new to this forum and looking for help.

I know this person who needs help as his benefits have been stopped and he is in fear of losing his council house as they have stopped all of his benefits.

What can I tell him he can do to get them back as he needs them to live and pay for stuff.

Not sure if you all need other info from me but i will check this to see what i can tell him as I am sure his benefits should not have been stopped and he is entitled to benefits.

    What benefit was he on? Why did he lose it?

    He says job seeking allowance a tthe minute but he is trying to get a sickness allowance if he can fill in the form right. He also gets council tax benefit, housing benefit. I think thats it.

    He lost it as he said the people at the benefits place stitched him up cause they dont like him. Said he didnt go, or didnt look for work when he says he did. Thats why he is going on sickness benefit now as i think less hassle.

    Does your friend actually have a disability? I hope I'm misinterpreting you because the bold above sounds a bit suspect.

    Are you sure he's been attending his interviews? He may not be telling you everything. If he's missed appointments he will have a sanction.

    He says he may have to take them to court for his benefits if he doesnt get sickness. could he do that?

    if his JSA has been stopped

    1. Appeal
    2. Claim hardship benefit
    3. Get onto the Council re new claims for HB and CTB uregently as he is still entitled to them.
    4. Get himself down to the local advice centre pronto.

  • No, unlikely to be able to especially if they have legitimately stopped his benefits for him not complying with the requirements.

    There is no universal right to them, he has to be entitled to them.

    I very much doubt you are being told the full story.

    As RAS advised, get him to appeal. Can he get in contact with his local citizens advice? I'd also get him to go to his GP if he's depressed, he'll need some help. He can contact charities like MIND for advice and help as well.

    Going to the court would probably be an over reaction. What is the crime and who committed it ?

    The courts are not just for criminal matters. People go to court for divorce hearings, legal evictions, to enforce debts, to secure child custody, etc etc etc, non of which are crimes. Courts are there to make decisions on legal issues.
