Someone please help. For years I have always had a private arrangement with the ex. He has paid well and on time for the children. As they have got older naturally the support has stopped. I now know that he is not paying enough for youngest and refuses to do so saying contact csa.( he is paying some) He says he has paid over and above over the years and this will be taken onto consideration. Is this True?

No, it won't be taken into consideration. The CSA don't get involved with anything other than maintenance from the date they are first contacted.

If he isn't paying now and you don't contact csa, presumably you get nothing.
If he isn't paying now, and you do contact csa, then you may get something?
The advice usually on here is that nrp should be very careful about private arrangements because it can be difficult to prove that they have been paid?? How was he paying and what was he paying?:heartsmil When you find people who not only tolerate your quirks but celebrate them with glad cries of "Me too!" be sure to cherish them. He has always paid but as each child has left education he has taken a third away (3 kids). He tells me he has paid over and above but I wouldn't know that as I no longer know what he earns for sure. He has given me a net figure for each month and going on csa calculator it is about 180 short of what he is currently giving. Thanks for replies!0

He is your ex now, what he earns is none of your business, as others have suggested, apply via the CSA, you maybe better off, you may be laughing from the other side of your face, but yes on todays formula, after the two older ones become of age, you can expect the monies to drop by 2/5.0 -
Sorry, but I'm s little confused. Would it go on what he used to pay 850 for 3 (he refuced by a third each time)or a csa calculator when they ask for proof of earnings? ( I assume csa would do that)0

Are you trolling? If he paid £850 a month for 3, that assumes he is netting about £3400.
So when the eldest becomes of age this would drop to £680 and when the 2nd comes of age then the figure would drop to £510.
Indeed that is not going to pay for private schooling, but then there is your own financial contribution too.0 -
It assumes nothing at all DUTR, surely? If he has decided how much to pay of his own accord and is saying it's the correct amount it might be. And it might not.
OP - you have a risk to take in contacting the CSA. Your ex may well have been paying over the odds for the last few years. And he might not. As you don't know what he earns, there's no way really of working out what might happen. If you are unhappy with the amount he is suggesting and believe it to be incorrect, then the CSA will help you get the correct assessment - but it may be less than you are receiving now.0 -
Trolling? What is that? He tells me net is 3000 and therefore I believe 280 to be not enough. I'm completely new to this and dont really understand all the lettering eg op dutr etc? I don't mind if it is less or more I just want it to be up front. I asked here because he says that csa will take into consideration overpayment over the years which I have no idea as I don't know earnings and rightly do why should i?! I am only trying to do what is right0

25% for 3 dropping to 20% for 2 and finally 15% for 3, and if he does not like that, then use the CSA, that is how it is, and there is nothing he can do about it...!
However, common sense, and a quick chat pointing him here and what the actual cost to him should it have to go down the route of the CSA might actually make him see sense...!
As a percentage what has he been paying of his income do you know...?0
