  • WHAT ???????? do make a habit of contacting people you don't think you owe to just to check , ha ha ...maybe you're right , I'll be writing off to anyone I've been financially involved with in the past to check I don't owe them anything .
    I have asked DWP for proof of the debt several times and received nothing .
    I think I may have posted this thread in the wrong place , it's advice on how to deal with a dodgy DCA I'm after

    you are in the wrong place, you want to avoid the debt. I am sure the debt free board can you assistance on how to do so.

    Most people don't owe anyone and pay their dues, hence this being the wrong board but on other boards they are experienced on how to deal with debt collections and I feel sure they can help more than here.

    And you really believe that the DWP will simply sit on a debt, doing nothing about it and then decide to lose money by paying another agency to recover the money?

    Ask for something under data protection and you'll see attempts at contact/recovery. I notice you didn't answer the question about whether you'd moved
    No , I thought that when I signed off in 2009 that the final payment took into account any money I owed .

    So you took a loan, had money deducted over whatever period and you thought that by some astonishing coincidence it all worked out very nicely that your last benefit payment exactly matched your final repayment.

    My other leg has bells on.
  • Not at all , I'm sure I was told that any money owed would be deducted from my final payment , if in case any money was owed I would have expected to be informed promptly so I could arrange repayment .......not 3 yrs later when my recollection of what was paid and when has somewhat diminished

    no they cannot deduct the amount you owe in one lump sum. They have a maximum amount they can deduct weekly which is why you pay back in installments. Why can you not accept you borrowed money, you need to pay it back. It is tax payers money, you were happy enough to accept money in your hour of need so pay it back. I dispute you have had no correspondence in three years unless you have moved and not notified the department. in one post you say yo refuse to repay and then in the next you are happy to pay. Call these people arrange a repayment schedule and stick to it.

    Sorry but that is wrong. They can pursue this or any other debt for as long as they want, although they can't seek payment through the courts after six years.

    They can deduct it off his old age pension in 30 or whatever years it takes from now to clear the debt if the DWP want to, or take it off any benefit such as Jobseekers if it is applied for in the future.

    poppasmurf is correct. The debt will be reclaimed from any DWP benefit you claim. Even if you don't make any claim for a benefit in between now and receiving the state pension, they will take deductions for repayment out of that.

    Perhaps the best way to stop the nuisance calls as you call them, is to repay the debt, or at least make an effort to set up a repayment plan. They would have no reason to call you then.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    I can hand on heart say that I've had zero/zip/zilch correspondance from DWP in 3 yrs sinced I signed off regarding this loan , nor have I moved address in that time .
    I do strongly object to a company attempting to harrass and intimidate me by calling every 2 hours and then hanging up , as far as I'm concerned they're most probably breaking the law and industry guidelines on what's exceptable when trying to reclaim money owed .
    I'm not comfortable dealing with or entering into an agreement with a company that harrasses and intimidates people .

    They have not broken any rules or regulations.

    You can ask them to only correspond in writing with yourself, which will stop the calls.

    However it would seem you owe the money, so they'll just carry on writing to you.

    As previously mentioned there is no limit to the time they can chase this debt for, they can and will take it out of any further benefit payment.

    My advice would be to arrange a repayment schedule with them after they send you a breakdown of monies owed, you need to ditch the idea that you are being hard done by and its everyone else to blame or are in the wrong.

    Not if they have sold on the debt to CCS collections. If they are acting for the DWP and just taking a cut then I agree with you.
    It's someone else's fault.
