Crisis Loan 2009

Can anyone help ,
I've been getting nuisance calls (pick up reciever no one there)from a firm called CCS Collections about a crisis loan from 2009.
DWP must have given them my number .
I've spoken to them once and told them that as there is no paperwork and my recollection of the loan is hazy after 3 yrs then I'm not paying , my understanding is that when I signed off in 2009 then everything was squared up when I received my last benefit payment .
Now I have been receiving silent/no-one there phone calls from them , not sure when it started , at least a couple of days ago .
Got fed up done the 1471 and got through to them .
Danny from CCS seemed to think it was perfectly acceptable to make these calls and as they use a call centre its ok .
I've asked for a complaints form but not to confident I'm going to get one and need help drafting a letter with the relevant legislation regarding nuisance calls PLEASE
I've already complained to Ofcom

if you borrowed money you need to pay it back, I presume you haven't claimed any benefit since you closed your claim, they would not have taken a final payment. You can call the benefit center and they can provide you will written details of the loan, how much was paid and when.
Other than that you should pay it back. Why should it be classed as nuisance calls? If you had taken a bank loan or pay day loan you would pay it back. Borrow money pay back don't see why you think you should be exempt unless you can prove you have continued with re-payments.0 -
I imagine a collection agency is being used because all other attempts at recovery of the debt have been ignored or dismissed.0

If they'd let me take the call I'd be quite happy to talk to them , cutting me off serves no purpose other than to harrass or intimidate which is not acceptable .0 -

Your words, so have you, or have you not spoken to them long enough to find out what they want? Are you, or are you not willing to arrange a re-payment method? DWP would not have given them contact details without trying to seek re-payment from you first. Are you honestly telling me that since you closed a claim to benefit back in 2009 until this first contact no-one from DWP has sent any form of correspondence asking for repayments? Are you still at the same address? DWP does not work like this, debts are only passed on once all other means are exhausted.0 -
The first I heard from DWP was a couple of months ago when I told them I had no intention of paying them after zero contact about any debt for 3 yrs .
I've also spoken to CCS once when I told them exactly the same thing .
They are more than welcome to chase me for the money I owe but only using the correct channels.
I fully accept that this money is probably owed but my personal opinion is that there should have been some contact within the last 3 yrs about this debt , I can't remember how much has been paid , I haven't any paperwork , the DWP haven't any paperwork , CCS haven't any paperwork regarding the debt .
I've been contacted over 3 yrs after the crisis loan was taken out and been told you owe £££ , pay up .
Now I have a debt collection agency apparently breaching several Acts trying to harrass and intimidate me by telephone .
I don't need advice on dealing with the debt I started the thread hoping to get some help with a debt collection agency breaking the rules on how they should be collecting said debt .
But hey , whatever floats your boat .0 -
They have up to 6 years to pursue this debt, which they may well enforce via the court if necessary0

Have you contacted them in the past three years, in the knowledge that you "probably owed" money?0 -
No , I thought that when I signed off in 2009 that the final payment took into account any money I owed . The first I knew about it was a couple of months ago .

You didn't check? In that case, you have been as negligent as the DWP. I suggest you contact the DWP directly and ask them for proof of this debt, they will send it to you and then you can make an arrangement to pay.0
